Ventura Short Sales: How To Avoid Any Surprises When Selling A Short Sale

Your BEST CHOICE FOR A REAL ESTATE AGENT SERVING VENTURA COUNTY CA, The Best Short Sale Agent in Ventura County, CA, The Best Short Sale Realtor in Ventura County, CA, The Best Certified Short Sale Specialist in Ventura County , CA, Your Top Listing Realtor with Prudential California Realty.[caption id="attachment_1235" align="alignright" width="288" caption="What? I Didn't Know We Had To Pay That Fee?!!"][/caption]

Moorpark CA – Many agents and buyers are scared of short sales. Here is something that I do to make the short sale process easier for the home seller.
Before I start negotiations with your lender, I will order a complete title search. Here is why I do that. I want to know all the costs upfront, before I give the bank a number.
Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
If I don't do this, then the short sale lender will approve the short sale at a certain price. We can get to the closing table and discover there are unforeseen costs.
Then we have to go back and re-negotiate with the short sale lender. This can be tough because they already have a higher number in mind.
Sometimes you have to start the short sale negotiations all over again. That can delay the short sale by 2-3 months, if not longer.
This trips up many agents and causes them to bad mouth short sales. Extra costs can show up in the form of higher than expected Homeowner's Association Dues, Property Taxes, and other costs.
The title company will do a complete title search. They will get an estimated payoff from the Homeowner's Association, and estimate the payoff for the taxes.
Since I take this pre-caution I have found short sales to be easy and fun. Before you hire a short sale agent, ask them about the short sale process. If they don't mention this step, then find another short sale agent.

Because most short sales are beneficial to a lender. If you accept our offer to help you on a short sale, your lender may not agree to a short sale or to modify your loan. We do offer a loan modification kit.
However, the likelihood of negotiating a modification is like everything else in life. It takes work and persistence to convince your lender to modify your loan. No matter what you or we do, your lender may not approve a loan modification.
We do not recommend that you stop paying your mortgage, because this will cause damage to your credit and could cause you to lose your home. Because we know avoiding foreclosure is so important to any homeowner, we recommend that you speak with the appropriate legal or tax advisor before making any decision.

You have the option to reject a short sale or loan modification from your lender if it does not meet your approval. If you decide not to go thru with the short sale, then you do not have to pay us our fee. We normally make a real estate sales commission for helping you on a short sale.

Step 3 To Fix Your Credit After A Ventura County Short Sale: Rank Items In Order Of Importance

Get your Free Report for All Your Options HERE: http://hosted.cdpe.com/175202/">Certified Distressed Property ExpertVentura County CA – The next step in going over your credit reports is to really rank the items being reported about you to find ones that are the most negative. Rank the negative items with the MOST negative ones given the lowest ranking.
You want to rank the ones that will cause the most damage to your credit score.
Here are the most damaging items (in order of damage amount): bankruptcy; foreclosure; repossession; loan default; court judgment; accounts in collections; payments that are past due; payments that are late; being denied credit; inquiries to open new credit.
One thing to note about disputing things on your credit report – items like court judgments and foreclosures and child support arrears are verified by a different system, and are rarely if ever disputable.
Here is one of the best suggestions that I have seen work well. Take a Sharpie pen, and mark on the unused copy of your report.
Circle the items you are disputing and write a SHORT note about why you are disputing that item – for example “Not my account” or “Not Late.”
I am not advising you to lie or make misleading statements when you write to the credit reporting company. However, I will tell you that if someone is reporting something about you, they should be able to prove that what they are saying is the truth.
The credit bureaus are required to check out and investigate all the disputes they get that are deemed to not be “frivolous or irrelevant.”
What that means is that you need to not dispute every single item on your report right now, and you need to be taken seriously.
This means DO NOT use the dispute form that they sent with your credit report. They see those forms as “frivolous” 9 out of 10 times.
DO NOT use their online dispute center – the credit bureaus don’t take those seriously because they think you can’t be too serious if you just click-click-clicked away to dispute it. Thinking about a short sale?

Step 7 To Fix Your Credit After A Ventura County Short Sale: The Waiting Period

boredVentura County CA – The next step in the process of getting a cleaned up credit report, is the one that takes the least effort, but the most patience: WAITING.

You’ve done your part to get the ball rolling, and now the credit reporting companies have to do their part.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

What happens during this phase is that the credit reporting agencies have 30 days to investigate. I use the term loosely here because the methodology that they use is not very investigatory. They take the claims and whittle the dispute down to a 2 digit code that gets checked against a reporting database called eOscar for verification.

They are afforded 30 days to do this step, unless the person disputing has gotten their credit report from annualcreditreport.com which allows them to take 45 days to check out your dispute (remember back in an earlier step where this was discussed – this isn’t the site to get your credit from!.)

While you wait, remember that whatever your credit score was before you began this process, you should be doing things now to improve it. What I mean by this is that while waiting for the history part of your credit report to be cleaned up, you work on the future of the credit report. Take action now to build a better situation.

First, keep your report clean from this moment forward. Don’t tarnish it beginning now. Do not have a single late payment – pay your bills on time. I know, it’s easier said than done, but it will be important in your future that you did this today. Don’t have any new collection accounts or charge offs.

Don’t, REALLY don’t, get new inquiries on your credit report – this means don’t open any new credit cards, store charge cards. No applying for everything that sounds like a good idea. Don’t close any open credit cards. Pay off the credit card - yes, but close out the account – no.

Keep this length of history long on your report. And, just wait. The 30 days for the credit bureau investigation will fly by. Once their 30 days is up, they have 5 additional days to provide you with their findings. If anything in their investigation was not verifiable, that item is required to be removed from your credit report.

They will also send you an updated credit report. So, watch for their letter to you in your mailbox after you complete the WAITING step. Thinking about a short sale? I can help you short sale your property and get back on your feet.

Ventura County Short Sale Help : Bankers, Please Stop Harassing Home Owners For Money They Don't Have

Ventura County Certified Short Sale Specialist, Ventura County Short Sale Help, Certified Short Sale Negotiator, Stop Foreclosure Institute of Ventura County, Ventura County CA – Maybe this is a pet peeve of mine. Or maybe it just seems ridiculous that someone would call a debtor over and over again asking to be paid, when they have already been told the debtor doesn't have the money to pay them.

Or maybe it is the fact that I see countless examples of debt collectors breaking the Fair Debt Collection Practices Act. But, no one seems to care that they are breaking the law.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

The Fair Debt Collection Practices Act forbids collectors from threatening to sue you, but then not following thru and actually filing suit. To get around this rule, they will use language that sounds legal, but isn't.

In one situation, a debt collection firm in Buffalo, New York named their firm Hoffman, Weinberg & O'Brien to make it sound like they were a law firm.

They would then leave messages on people's answering machines. They would say they were with the office of Hoffman, Weinberg & O'Brien and then say they may resort to future legal action.
Or they would say they were calling about a pre-legal matter. In addition, they would reference case number 8306042. If you didn't know any better, you would think the case number was for an actual lawsuit against you. Scary, right?

In addition, if a debtor tells them not to call anymore, then they are supposed to stop calling. They just keep on calling anyways. This is another example of them not obeying the law per the Fair Debt Collection Practices Act?

I allege that they willingly and knowingly break the law repeatedly. This is why we put Number Seven onto the Homeowner's Bill of Rights:

7. Stop the Debt Collector Harassment! The right to tell any and all debt collectors to stop calling and never receive a phone call from then again.

In addition, this would include debt collectors that know the person's phone number, but will call family members in an attempt to embarrass the debtor.

This is America people! Debtor's prison was abolished two centuries ago! It's time to update your activities to the Twenty-First Century!

Or take another example. A homeowner has never made a late payment in their entire life. They lose their job and find one in another state.

The move, try to rent out their house, but can't afford the payments. They get behind on their mortgage payment and credit cards. They enter the world of non-stop harassment.

Debt collectors call them non-stop. These people aren't deadbeats. They are just struggling at the moment. They won't stop calling even when the debtor asks them to stop.

They would pay if they had the money. But they don't have it. But, the people won't stop calling. The constant phone calls make their home life miserable. Don't you think it has gone too far?
I do. That's why we need a Homeowner's Bill Of Rights. Stop the debt collector harassment. What do you think? Please put your comments below. Thinking about a short sale?

Ventura County Short Sale Help: Can You Convince My Bank To Erase My Upside Down Debt, They Won’t Return My Phone Calls?

Moorpark Short Sale SpecialistVentura County SHORT SALE HELP – Many people have a hard time believing that their lender would agree to allow them to short sale and walk away from the upside down debt.
If you have ever gotten behind on payments, then you know how mean the debt collectors can be. The constant barrage of threats, demands, and phone calls usually proves to be too much for most people.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

As a result they give up. Debt collectors are mean. But, it is a tough job (although I have no sympathy for them.) I know someone who used to work as a debt collector.

He quit after a couple of weeks. It was just too harsh and depressing. They get on the phone every day for 8 hours of abuse. Some of the people they call scream at them.

Very few people are nice. It's probably very depressing because you hear about other people's problems all day long. The debt collectors become cold and callous as a result of the work.
As a result, they take their frustrations out on the people they call. If you are trying to negotiate a loan modification or short sale, do not work with the debt collection people.

They don't want you to modify your loan or keep your home. Why is that? Because they are paid bonuses on the money they collect.

They don't receive a bonus if you short sale or modify your loan. The debt collection people are an ugly, dull, almost useless tool. The lenders use them in a half hearted attempt to get you to pay.
You see lenders don't want you to short sale or modify your loan. They just want you to catch up your payments and start paying on time again. That way they don't lose any money.

The debt collectors are the first line of offense. "Sic em", they say to the debt collectors, hoping they can convince you to catch up your payments.

Fortunately, when we negotiate a short sale we talk to a different group of people. These people work in a different department. They are not callous and cold. They don't hate their job.

They are paid substantially better than the debt collection folks. For most it is an actual career. These people have training. They approve and deny short sales based on set criteria.

Their job is to process the short sale, not collect money. They know that most people are selling their home because they can't afford the payments. So they don't bring it up.

We do all the negotiations and discussions with them. That means when you start the short sale process, you don't have to talk to the people at your lender anymore.

We take over and handle everything for you. You can rest easy knowing that someone else will be negotiating on your behalf with your lender. Thinking about a short sale?

I Need Ventura County Short Sale HELP!!: How Much Of My Debt will Be Forgiven When I Short Sale?

Moorpark Foreclosure Help, Moorpark Loan Modification Help, Moorpark Short Sale Help, Moorpark Short Sale Specialist Chris B Johnson Realtor, Moorpark Short Sale Specialist Ventura County CA – The Stop Foreclosure Institute recently received a question from Kevin. Here was his question.

"I am upside down on my house. I owe over 700k and I have been told that it is now worth under 400k. I just hate to think how much it will cost me over the long term when you add in the interest I will repay.

I am wondering if my bank will forgive the entire debt in a short sale. What do you think? Kevin."

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Here was our answer to Kevin's Question. Most of the short sales we are doing have results in the complete forgiveness of the upside down debt.

There are many different factors involved, such as the law in your state, the bank who has your debt, whether or not you have mortgage insurance, and a number of other factors.

But, in most cases the short sale results in the forgiveness of the debt. In other cases, we have negotiated a 100k debt down to a 13k promissory note.

It's not fun to repay that, but it's much better than repaying the entire debt. I can give you a better answer when I discuss your situation with you. Thinking about a short sale?

I can help you short sale your property and get back on your feet. Send me an e-mail at cjohnson@prucalhomes.com. I will contact you for a free consultation.

Need Ventura County Short Sales Help?: The Bank Won’t Release Me From My Upside Down Debt. What Can I Do?

The Best Short Sale Agent in Moorpark, CA, The Best Short Sale Realtor in Moorpark, CA, The Best Certified Short Sale Specialist in Moorpark, CAVentura County CA – I recently met a realtor who sells properties in a beach town. “Short sales take 9-12 months. The banks are so hard to deal with”, she said.
She mentioned short selling a customer’s property. The sellers were two doctors that had to take a promissory note. The sale was for 900k, so the loss must have been above average.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

In this case, her customer’s were ok with a promissory note. But, what if you want to short sale and walk away from the updside down debt?
What can you to do short sell your home without a promissory note. Negotiating short sales on more expensive homes is different than your average short sale.

The most common loan types that will give you a complete release are Fannie Mae, Freddie Mac, FHA, and VA. Most of them won’t loan on a mortgage over $417,000.

There are a few exceptions, but that is the general rule. If your mortgage amount is more than $417,000, then your loan is probably owned by the bank you originally got it from, or it has been securitized.

Many of these loan owners will not grant a release. You will have to use other methods. First, you can tell them that you are broke. If that true, then they may let you off without much ado.

If you have assets, then you will need to use different tactics. You can hire someone to do a “Loan Audit.” This is where they go thru your loan file and search for any violations of lending laws.

Maybe they didn’t give you the proper federally required mortgage disclosures. Maybe the mortgage broker or lending company wasn’t properly licensed. A loan audit will often help your case.

But, it isn’t an “end all, be all”. I’ve seen people promote it as that. Another thing you can do is hire on a good attorney. You will want to deal with someone who is a consumer advocate.

They will know how to use the law to negotiate from a position of power on your short sale. In my opinion, the best way to hire lawyer in this case is on a contingency.

Tell the lawyer, "I will pay you X when you get me what I want." Some people think lawyers drag cases on just to earn more money. Using a payment arrangement like this will help you avoid that.
However, the most important thing you can do is to hire on an experienced short sale agent. Ask them if they have negotiated any short sales where the lender asked for a promissory note.

Then, ask them what they did to negotiate away the promissory note. The good short sale agents will usually know a good attorney. They may have experience dealing with your bank.

Bottom line: They are the person who can point you in the right direction so you can short sale and walk away with a complete release from the debt. Thinking about a short sale?

Here Is A Unique Strategy To Make Ventura County Short Sales Faster & Easier

The Best Short Sale Agent in Ventura County, CA, The Best Short Sale Realtor in Ventura County, CA, The Best Certified Short Sale Specialist in Ventura County , CAVentura County CA – Yesterday we discussed a serious problem affecting the short sale industry. Today, we are going to lay out a strategy that the short sale sellers can use to help solve this problem.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

The biggest reason that this problem can continue is because the realtors assisting you never receive a copy of your home's valuation. If we had copies of those valuations, then holding the people accountable would be much easier.

The banks won't give us the information. And we really don't have the right to it. But, you, the home seller, does have a right to it under the Equal Credit Opportunity Act

Here is what you can do to get your hands on your bank's property valuation.

1. Request a complete itemized payoff from your lender. You do this by faxing them a request. Usually you will get an answer in 7-10 business days.

2. Review the payoff to see where the property valuation is itemized. It will usually be called an "Appraisal" or "BPO." If not, it may be included in some other payoff cost.

3. Since this is part of what you owe on this mortgage, then you have a right to a copy under the Equal Credit Opportunity Act. Fax the lender's legal department a request for a copy of it.

Send a copy of the payoff and circle the spot where you think the BPO payment is. Request a copy for the borrower under the Equal Credit Opportunity Act. In addition, also mail the lender's legal department the same request.

If your lender does not comply, then you can file a complaint with the Federal Trade Commission at www.ftc.gov, The Office of Thrift Supervision at www.ots.treas.gov, The FDIC at www.FDIC.gov, and the Comptroller of the Currency at www.helpwithmybank.gov.

Indicate on your correspondence with the lender that if they do not comply, then you will be filing complaints against them.

Once you receive a copy of your home's valuation we can use that date to facilitate the short sale process. Thinking about a short sale?

Here’s a Ventura County Short Sale Question: Can I Short Sell My Home If I Have More Than One Mortgage and a Lien?

Chris B. Johnson Realtor is a Certified Distressed Property Expert and Certified Pre-Foreclosure Specialist. With a full time staff dedicated to short sale negotiations and transactions, we have been successful with every short sale to date. All the mortgages on the property will have to be satisfied before you can give clear title to the buyer. But the most important negotiation is the one which has to be made with the lenders; which will be two or three in case of multiple mortgages on your home.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Negotiating with two or more lenders might seem to be an intimidating task. But, you do
have a strong negotiating position because second mortgages typically receive nothing if the home is foreclosed by the primary lender.

It is also possible for the first mortgage company to reject a short sale offer if they thinks that they can do better with a foreclosure. Most second mortgages lien on the property is wiped out in a foreclosure.

They will opt for that if the second mortgage is demanding to much money to approve the short sale. A second or third mortgage is called a junior mortgage.

(Third mortgages are rare. We have never seen a fourth mortgage on over 100 short sales we have worked on.)

The junior mortgage received a much smaller percentage of whatever they are owed. Most of them agree to the short sale with them being paid $3,000, and sometimes less than that.

The easiest second mortgage negotiations are short sales of piggyback loans. A piggy back loan is the junior mortgage when a single bank issues two mortgage against the same house.

This was very common during the housing boom. The loan officers at many banks offered this combination to borrowers. The costs were usually lower than getting just one mortgage and the banks agreed to the loans.

This piggy back loan is the second mortgage which is written off by the same lender as of the first mortgage. In this case the realtor or the home owner will be able to negotiate with a single person at the bank that is handling the two loans. Thinking about a short sale?

How We Convince A Lender To Approve A Ventura County Short Sale

Ventura County CA – In yesterday's blog post we explained why some realtors consider short sales to be a "nightmare." Then, we explained how we do to inform the actual loan owner of the lender's negligence.

Today, we'll explain how this works if the lender owns the loan in house. After all, there is no third party loan owner who will hold the lender accountable. Here is what you do in this situation.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

First, contact the CEO. We have a solid strategy that will puts us in contact with the CEO of almost any bank. We have used this strategy to contact the CEO of Bank of America, JP Morgan Chase, Suntrust, and many other lenders.

Then, we detail the problem with the CEO and explain how much money their company will lose if they do not approve the short sale. We have a calculator that we use that breaks down these numbers.

It is based on examples of when a lender turned down a $385,000 short sale offer, foreclosed on the house, and then sold it for $230,000.

(Most people would be shocked at how much banks lose because of their flawed short sale processes.)

Here is what happens when this process is carried out effectively. We contacted the CEO of a Top 20 American Bank. We explained how the short sale department wouldn't respond to emails or phone calls.

Then, we explained that we estimated this would cause his bank to lose around $30,000. We backed up our estimate with examples of other lenders who rejected a short sale and lost tens of thousands more after foreclosing the property and then selling it.

The CEO wasn't happy (to say the least.) Later that day the head of the short sale department called us to discuss the file. He gave us his direct phone number and begged us to never call the CEO again.
You have to remember that every dollar is important to these CEOs. They work so hard to increase earnings every way possible. They don't care about excuses. They want results.

They assume that every employee and department could work harder and do a better job. When you show them how someone is not doing their job and costing the bank $30,000, then they are unhappy.
Obviously this CEO was under a lot of pressure to boost earnings. We learned he had been replaced a few months later. Thinking about a short sale?
