Despite escalating talk on tariffs, the Dow Jones Industrial and S&P 500 both hit all-time highs this week, sending bond yields higher as part of a month-long trend.
By Friday mid-morning, the Dow had topped 26,700 points, pushing the all-time mark higher after first hitting a new record on Thursday. This was the first new all-time high since January.
The latest improvement can be attributed to receding fears of a trade war. More tough talk on tariffs this week suggested to many investors that tariffs may be less harmful than originally thought, especially as the Trump Administration seemed to out-leverage China in the latest spat.
The Trump administration announced on Monday it would impose a 10 percent tariff on $200 billion worth of Chinese imports, which would rise to 25 percent by year-end. China retaliated Tuesday by announcing levies targeting over 5,000 American products worth $60 billion and to go into effect next week.
Many analysts now expect a deal between China and the U.S. may be on the table in the months ahead.
Meanwhile, continued economic expansion prompted investors to sell off bonds, which drove yields higher. The 10 Year Treasury, which is closely followed by mortgage rates, headed toward 3.1 percent, punctuating a month-long trend. We need to watch this carefully as the bond markets are approaching some technical trading levels that could push the 10 Year Treasury to 3.25 percent. Rising mortgage rates, with volatility mixed in, remains the forecast.

This bond yield increase is happening for the following reasons: 
  • Investors believe economic growth here and abroad is real. They’re buying equities because of real economic growth – not just inflation – and stabilization in emerging markets abroad.
  • Tariffs. While some analysts have predicted intensifying tariffs and trade wars between the U.S. and other developed economies will drive inflation higher, recent evidence shows it only has attributed about 6 bps to the move.
  • The Fed is closing in on another rate hike, and many investors believe they will increase rates twice by the end of the year. They also believe the long-term dot-plot map of projected rate hikes will increase. This would put a higher floor on interest rates. 
  • Some of the move is also just tactical. The market had too much supply in 10 and 30-year Treasurys last week and needed to sell (don’t forget the Fed is selling Treasurys at a higher rate right now to support federal spending). Plus, corporate bond supply has been heavy, which weighs on rates. At the same time, large pensions funds have less appetite for bonds because of some tax policy change that expired last week. As a result they moved more funds into equities.
Housing and tariffs
Existing home sales for August were unchanged at 5.34 million, according to the monthly report released this week. This followed four months of declines, giving investors some optimism about the housing market. Home sales have been under stress due to several headwinds, including limited supply, higher costs and increased mortgage rates.
The National Association of Homebuilders this week came out with strong statements against President Trump’s trade policies. They claimed the latest round of planned tariffs on Chinese goods would increase housing costs and hurt affordability.
NAHB estimates 600 products, representing $10 billion in goods, in the latest list of products to face tariffs are related to the construction of new apartments and homes.
Trump is proposing a 10 percent tariff on $200 billion in Chinese goods, effective Sept. 24., with that rate to increase to 25 percent in January.   
“President Trump’s decision to impose 10 percent tariffs on $200 billion worth of Chinese imports, including $10 billion of goods used by the residential construction sector, could have major ramifications for the housing industry,” NAHB Chairman Randy Noel said in a statement. “With housing costs on the rise, this action translates into a tax increase on housing… Further, this tax increase is coming on top of the current 20 percent tariffs on softwood lumber imports from Canada. The lumber tariffs have already added thousands of dollars to the price of a typical single-family home.”

Property damage and disruption from Hurricane Florence is expected to total $22 billion, according to a Moody’s estimate released this week. As flood damage continues to be uncovered, the total could rise.Moody’s said Florence is among the 10 costliest hurricanes on record in the U.S.While the damage and recovery is expected to have a minimal impact on national GDP, the lasting effects will be felt in the Carolinas for years. The amount of rebuilding is massive and labor shortages in construction already will likely slow some of the recovery.Please keep our friends and neighbors who are recovering in your thoughts and prayers. Ventura County-Moorpark Short Sales: Are Lenders So Desperate They Will Accept Any Offer?

Have you heard the following myths about short sales? 

Myth #1: You can buy short sales for dirt cheap and then turn around and resell them for a profit.

 Myth #2: Foreclosures, Short Sales, and Bank Owned Homes can be bought for 30 to 50 cents on the dollar with no money down.

  Myth #3: Lenders will accept any short sale offer even if it is for only 50% of what the home is worth. After all, they don’t want a foreclosure on their books. These myths are just not true. Lenders are willing to foreclosure on properties. They have entire departments handle the sale of properties that they have foreclosed on. Another foreclosure is nothing to fear.

At the same time, they do prefer short sales. Short Sales are known to reduce a lender’s loss compared to a short sale. They have high paid actuaries who have run the numbers and proved that to be the case. That means they take a pragmatic approach on short sales.

 They want to make sure that he short sale offer isn’t lower than what the home would sell if they foreclosed on it. That is why they order an appraisal before accepting the offer. They won’t agree to a sale if the offer is for substantially less than the appraised value.

If the offer is 5% lower than the appraisal, then they might accept it. If it is substantially less, then they will ask the buyer to raise their offer to the appraised value. Another thing lenders check before approving a short sale is that they aren’t approving a short sale for someone that is able to afford their home. They don’t want to lose money on a short sale when they can make money when the person repays the loan.

Ventura Short Sales: How To Avoid Any Surprises When Selling A Short Sale

Moorpark CA – Many agents and buyers are scared of short sales. Here is something that I do to make the short sale process easier for the home seller.
Before I start negotiations with your lender, I will order a complete title search. Here is why I do that. I want to know all the costs upfront, before I give the bank a number.

If I don't do this, then the short sale lender will approve the short sale at a certain price. We can get to the closing table and discover there are unforeseen costs.
Then we have to go back and re-negotiate with the short sale lender. This can be tough because they already have a higher number in mind.
Sometimes you have to start the short sale negotiations all over again. That can delay the short sale by 2-3 months, if not longer.
This trips up many agents and causes them to bad mouth short sales. Extra costs can show up in the form of higher than expected Homeowner's Association Dues, Property Taxes, and other costs.
The title company will do a complete title search. They will get an estimated payoff from the Homeowner's Association, and estimate the payoff for the taxes.
Since I take this pre-caution I have found short sales to be easy and fun. Before you hire a short sale agent, ask them about the short sale process. If they don't mention this step, then find another short sale agent.

Step 4 To Fix Your Credit After A Ventura County Short Sale: Write The Credit Bureaus

Ventura County CA – Using your work on the credit report, you are ready to take action. You are now going to write a letter to the credit bureaus about the items you’ve highlighted and noted.
 
 
You are writing to the credit bureaus because they are the ones reporting the information – it is up to them to change what they report.
 
The goal is to get bad things deleted from your credit report in order to improve your score.
Do not go to Google, or bing and try to find a form letter than you should send in for this step! The credit reporting companies can spot those like a hunting dog can spot a duck.
 
You will not get anywhere with a “canned” letter, and will damage your chances of ever resolving issues.
 
Your letter should sound like you are frustrated (which you undoubtedly are), and should sound authentic. But, do sound polite and friendly.
 
Don’t sound like an expert, but do sound like you expect action. In this round of letters – your aim is to have the credit bureaus remove items that are hurting your credit score.
 
The bureau will then have to investigate your dispute and REMOVE any of the disputed items if they can’t prove them to be accurate (this involves them contacting the original creditor and verifying with them – all within the short 30 day window allowed by law).
 
Here is the basic outline to follow for your first round of letters you send:
 
At the TOP of the letter, put your name, SSN, current address (and state lived there for X years), and your DOB.
Say something about how you’ve just reviewed your credit report, and found items that are inaccurate.
List the items BRIEFLY. Say something like: “Chase Credit Card xxx-xxx-xxxx, listed for 30 days late. I have never been late on this account,” or “Citi Credit Card xxx xxxx xxx listed as collections. This is false.”
 
Note that you are upset / worried / distressed / embarrassed about these items, since you know they are negatively affecting your credit score.
 
Ask that these items be deleted from your report immediately.
Add Sincerely, and your name below. Sign the letter.
 
Include a photo copy of your driver’s license as proof that you are you making this request. Also include proof if you have it (credit card statement from the month where they say you were late when you weren’t.)
The next step is to submit this letter.

Step 5 To Fix Your Credit After A Ventura County Short Sale: How To Mail The Letter

The goal is to get your letter read, taken seriously, and responded to.

**Make sure you make a copy of whatever you are sending to the credit bureaus.** Just keep all your credit reports, letters, etc. in a file so you can use these later (this will be important.)

Send your letter, a copy of the credit report with the items you are disputing noted in Sharpie, and a copy of your driver’s license to each of the credit reporting companies.

This step CAN be a bit tricky, even though it should be the easiest step of all! Here’s why – the credit reporting firms don’t really like to deal with these dispute letters, and they change their mailing address for submitting these requests fairly often.

You will need to go to the website for Experian, Equifax, and Trans Union to get their dispute address. BUT DO NOT SUBMIT YOUR DISPUTES ONLINE, like their websites pushes you to do.

If you do this, your request is less likely to be taken seriously, and you won’t have any written record of what you submitted. Send each of your letters as Certified Mail. Your local post office will help you with this. Put the copy of the certification slip into your file as well. The certification slip ensures that you have a timeline started for restoring your credit.

Step 7 To Fix Your Credit After A Ventura County Short Sale: The Waiting Period

boredVentura County CA – The next step in the process of getting a cleaned up credit report, is the one that takes the least effort, but the most patience: WAITING.

You’ve done your part to get the ball rolling, and now the credit reporting companies have to do their part.

What happens during this phase is that the credit reporting agencies have 30 days to investigate. I use the term loosely here because the methodology that they use is not very investigatory. They take the claims and whittle the dispute down to a 2 digit code that gets checked against a reporting database called eOscar for verification.

They are afforded 30 days to do this step, unless the person disputing has gotten their credit report from annualcreditreport.com which allows them to take 45 days to check out your dispute (remember back in an earlier step where this was discussed – this isn’t the site to get your credit from!.)

While you wait, remember that whatever your credit score was before you began this process, you should be doing things now to improve it. What I mean by this is that while waiting for the history part of your credit report to be cleaned up, you work on the future of the credit report. Take action now to build a better situation.

First, keep your report clean from this moment forward. Don’t tarnish it beginning now. Do not have a single late payment – pay your bills on time. I know, it’s easier said than done, but it will be important in your future that you did this today. Don’t have any new collection accounts or charge offs.

Don’t, REALLY don’t, get new inquiries on your credit report – this means don’t open any new credit cards, store charge cards. No applying for everything that sounds like a good idea. Don’t close any open credit cards. Pay off the credit card - yes, but close out the account – no.

Keep this length of history long on your report. And, just wait. The 30 days for the credit bureau investigation will fly by. Once their 30 days is up, they have 5 additional days to provide you with their findings. If anything in their investigation was not verifiable, that item is required to be removed from your credit report.

My Ventura County Short Sale Is Taking Too Long Because Lenders Can't Write Off Too Much Loss At Once...WHAT???

Your Ventura County Short Sale Specialist receives emails all the time that go something like this "The Bank’s Short Sale Problems are not that simple. A bank can't afford to write off too much loss at once. Also, their investors may not approve the short sale, because they can't afford to write off too much loss at once either. And the circle goes on."

Here is why this flawed assumption is incorrect. Most of the large, national banks do not own the mortgages they handle. As an example, Bank of America does not own 80% of the mortgages they service. The biggest holders are the GSEs: Fannie Mae, Freddie Mac, and Ginnie Mae.

These entities are accustomed to losses. The other entity that's set up well and accustomed to losses is FHA. Most of the remaining loans are owned by Wall Street Firms, Pension Funds, and other professional investors. Most of the loans owned by them have already been written down in value dramatically. In a few, isolated instances, the "We don't want to write off losses to fast because it will hurt this quarter's earnings" thing applies. But, it is also illegal because of accounting rules.

Not writing off losses that you know about could be considered insider trading by many. Besides, when you push the loss on non-performing loans off to the future, the losses are bigger in most cases. Any prudent person would agree that making losses bigger is bad business. The bigger problem is that the lenders don't have enough staff to process the files.

They need short sale negotiators to submit files to the owners of the loans. As an example, on a recent FHA short sale, the negotiator told us it would take her 2-3 weeks to review the offer and then submit it to the FHA. However, she did tell me that FHA only has a 72 hour turnaround from when she submits the file to them. That is pathetic.

Here is why the lender doesn't have any incentive to hire on more staff. On that file, the lender isn't losing the money, FHA is losing it. Therefore why should the lender spend money to hire on more staff? There is no incentive to do so.

Ventura County Loan Modification Question, Can I Rent My Home If It Is "In Foreclosure"?

Your Ventura County Short Sale Realtor recently received a question about renting a home in foreclosure.

Short Sale Question: "I am own two homes that are in foreclosure. I would like to rent the homes during the foreclosure process. I will continue to pay the homeowner's association fees. I will not be paying the mortgage. Is it legal to do this? Is there any liability that comes with it?"

Here was our answer to them. I am not a lawyer. Therefore, we can’t answer as to whether or not it is legal. We recommend that you check with a lawyer before making a decision. We do know that there are laws forbidding that practice in many states, and California has very strict DISCLOSURE LAWS!!

For example, Sacramento recently passed a law that stated that you had to notify any potential renter whether or not the home was in foreclosure before renting. From what we have heard about the law, if you lease a property in foreclosure and don't tell the tenants, then it is a criminal offense. If it was a problem in California, then it was a problem in other states and they probably passed similar laws.

 We have seen cases in the past where a homeowner sold their home as “Owner Financing. The home was in foreclosure and buyers filed a police report. The sheriff’s office investigated the homeowner for fraud. The people who thought they were buying the home paid the owner a large down payment. They didn’t know the home was in foreclosure. He disappeared with their money and they were kicked out by the bank.

The bottom line is that anything fishy can have future repercussions. That is why I think it is better to disclose it first.
