Ventura County Short Sales: Can I Short Sale If I Have Substantial Assets & Good Income?

Here is Dave's Question. "I bought several investment properties at the peak of the market. The homes have dropped in value by almost 40% and I am losing money on the rent every month. I am sick of writing a check every single month to cover the loss.

I would like to short sale these properties if possible. I am just wondering if the banks would allow it. What do you think?”

Here was our answer. Dave, there is no answer that is correct 100% of the time. In your situation, it depends on your lender. Many lenders will allow a short sale. Others won’t talk to you until you are behind on the payments. I do know a friend of a friend who is in a situation very similar to yours and is short selling several properties.

He has substantial assets and a good income. Some of the banks were easy to work with. He was able to stay current on the payments until they approved the short sale. However, some of the other banks weren’t as easy to work with. He had to stop making payments before they would talk to him.

It all depends on the bank and how much you want to short sale. I know several people that write big checks every month just trying to stay afloat on their rental properties. If you aren’t planning on buying another house for 2-3 years, and want to stop the bleeding, then a short sale is a great option. If I were you, then I would attempt a short sale. It doesn’t cost you any money. I don’t see how you can lose.

Step 6 To Fix Your Credit After A Ventura County Short Sale: Why It’s So Important To Document Everything

The credit reporting companies have 30 days (by law), to investigate and handle the disputes submitted to them. This is why you submitted everything through certified mail.
That enables you to record the time firmly for the credit reporting firms to respond within. But it’s more than that. This file will become important for a long time for you.
Many people successfully removed items from their credit reports. Later on they found those same items show back up on their credit report months in the future! Having a record of your efforts and the results is needed to keep your record blemish free in the future.
Make your records easy to follow. You will need to keep the original copy of your credit reports here, as well as the copies you’ve made notes and comments on.
Keep copies of the letters you send to the credit reporting companies. Keep the Certified Mail slips. File any correspondence that the credit reporting companies send to you.
Keep a journal in your file of any telephone conversations you have with any of the creditors or credit reporting companies. Record in this journal the names, dates, times, and notes of these phone calls.
In addition, have a method to remind yourself of “action step dates” – those dates where you expect to have a certain action done by the credit reporting firms.
This can be a calendar you keep on the front of the file, or use Outlook’s calendar feature, or your calendar app on your phone.
This may seem like your credit report has become your new part time job, but with a little bit of organization and perseverance, it will be worth it! Thinking about a short sale?

Ventura County Short Sale Question: Can My Lender Charge The Buyer A Fee To Buy My House ?

Ventura County Short Sale HELP!! – Your Ventura County Short Sale Realtor recently received a question from Brandon. Brandon is selling his house and something very interesting happened.

Brandon’s Question: "My lender is tring to charge a 1% short sale processing fee to the buyer. Is that legal? The buyer is upset. They have stipulated that ONLY the buyer can pay the fee. This was never revealed until the short sale approval letter arrived. Brandon."

Our comments on this. Yes, the buyer is upset. Buyers think they are in control in today's market. They can't see why they should pay a fee if they are buying a house in a "Buyer's Market." Is it legal?

We did a short sale with the same lender and they said their lawyers had checked it out and confirmed that it is legal. So, it probably is legal. We checked with Brandon and found out a little more information. Turns out the loan is owned by Deutsche Bank.

We convinced the lender to waive the fee on that short sale. We threatened to contact Deutsche Bank and let them know what was happening. Sure, it's wrong. But, do you know why this lender can get away with it? It's because the people who own the mortgages don't know about the fee. When you threaten to contact the loan owner, then that changes everything.

Ventura County Short Sale Help : Bankers, Please Stop Harassing Home Owners For Money They Don't Have

Ventura County Certified Short Sale Specialist, Ventura County Short Sale Help, Certified Short Sale Negotiator, Stop Foreclosure Institute of Ventura County,  Ventura County CA – Maybe this is a pet peeve of mine. Or maybe it just seems ridiculous that someone would call a debtor over and over again asking to be paid, when they have already been told the debtor doesn't have the money to pay them.

Or maybe it is the fact that I see countless examples of debt collectors breaking the Fair Debt Collection Practices Act. But, no one seems to care that they are breaking the law.

The Fair Debt Collection Practices Act forbids collectors from threatening to sue you, but then not following thru and actually filing suit. To get around this rule, they will use language that sounds legal, but isn't.

In one situation, a debt collection firm in Buffalo, New York named their firm Hoffman, Weinberg & O'Brien to make it sound like they were a law firm.

They would then leave messages on people's answering machines. They would say they were with the office of Hoffman, Weinberg & O'Brien and then say they may resort to future legal action.
Or they would say they were calling about a pre-legal matter. In addition, they would reference case number 8306042. If you didn't know any better, you would think the case number was for an actual lawsuit against you. Scary, right?

In addition, if a debtor tells them not to call anymore, then they are supposed to stop calling. They just keep on calling anyways. This is another example of them not obeying the law per the Fair Debt Collection Practices Act?

I allege that they willingly and knowingly break the law repeatedly. This is why we put Number Seven onto the Homeowner's Bill of Rights:

7. Stop the Debt Collector Harassment! The right to tell any and all debt collectors to stop calling and never receive a phone call from then again.

In addition, this would include debt collectors that know the person's phone number, but will call family members in an attempt to embarrass the debtor.

This is America people! Debtor's prison was abolished two centuries ago! It's time to update your activities to the Twenty-First Century!

Or take another example. A homeowner has never made a late payment in their entire life. They lose their job and find one in another state.

The move, try to rent out their house, but can't afford the payments. They get behind on their mortgage payment and credit cards. They enter the world of non-stop harassment.

Debt collectors call them non-stop. These people aren't deadbeats. They are just struggling at the moment. They won't stop calling even when the debtor asks them to stop.

They would pay if they had the money. But they don't have it. But, the people won't stop calling. The constant phone calls make their home life miserable. Don't you think it has gone too far?
