Step 5 To Fix Your Credit After A Ventura County Short Sale: How To Mail The Letter

The goal is to get your letter read, taken seriously, and responded to.

**Make sure you make a copy of whatever you are sending to the credit bureaus.** Just keep all your credit reports, letters, etc. in a file so you can use these later (this will be important.)

Send your letter, a copy of the credit report with the items you are disputing noted in Sharpie, and a copy of your driver’s license to each of the credit reporting companies.

This step CAN be a bit tricky, even though it should be the easiest step of all! Here’s why – the credit reporting firms don’t really like to deal with these dispute letters, and they change their mailing address for submitting these requests fairly often.

You will need to go to the website for Experian, Equifax, and Trans Union to get their dispute address. BUT DO NOT SUBMIT YOUR DISPUTES ONLINE, like their websites pushes you to do.

If you do this, your request is less likely to be taken seriously, and you won’t have any written record of what you submitted. Send each of your letters as Certified Mail. Your local post office will help you with this. Put the copy of the certification slip into your file as well. The certification slip ensures that you have a timeline started for restoring your credit.

My Ventura County Short Sale Is Taking Too Long Because Lenders Can't Write Off Too Much Loss At Once...WHAT???

Your Ventura County Short Sale Specialist receives emails all the time that go something like this "The Bank’s Short Sale Problems are not that simple. A bank can't afford to write off too much loss at once. Also, their investors may not approve the short sale, because they can't afford to write off too much loss at once either. And the circle goes on."

Here is why this flawed assumption is incorrect. Most of the large, national banks do not own the mortgages they handle. As an example, Bank of America does not own 80% of the mortgages they service. The biggest holders are the GSEs: Fannie Mae, Freddie Mac, and Ginnie Mae.

These entities are accustomed to losses. The other entity that's set up well and accustomed to losses is FHA. Most of the remaining loans are owned by Wall Street Firms, Pension Funds, and other professional investors. Most of the loans owned by them have already been written down in value dramatically. In a few, isolated instances, the "We don't want to write off losses to fast because it will hurt this quarter's earnings" thing applies. But, it is also illegal because of accounting rules.

Not writing off losses that you know about could be considered insider trading by many. Besides, when you push the loss on non-performing loans off to the future, the losses are bigger in most cases. Any prudent person would agree that making losses bigger is bad business. The bigger problem is that the lenders don't have enough staff to process the files.

They need short sale negotiators to submit files to the owners of the loans. As an example, on a recent FHA short sale, the negotiator told us it would take her 2-3 weeks to review the offer and then submit it to the FHA. However, she did tell me that FHA only has a 72 hour turnaround from when she submits the file to them. That is pathetic.

Here is why the lender doesn't have any incentive to hire on more staff. On that file, the lender isn't losing the money, FHA is losing it. Therefore why should the lender spend money to hire on more staff? There is no incentive to do so.

Here Are Five Facts you Should Look Into When Considering A Ventura County Short Sale

  Short Sale if you are a financial superman. If you are a CPA or a Number Cruncher, then you understand that numbers are more important than warm and fuzzy thinking. Take a look at GM and all the businesses that “Short Sale.” You can call it that. They know the numbers are what matter to them. If you are too far upside down, then is better to walk away from the debt and start over.

  Do NOT Short Sale if you are going to make TONS of money in the future! You can probably convince your lender to grant you a loan modification and get back on your feet.

  Short Sale if you can find a rental home comparable to your home. You have to live somewhere. We have seen lots of homeowners find a nicer home to rent for a lower monthly payment than their “upside down” home. They Short Sold their house and were able to live a happier, more stress free life afterwards.

  Do NOT Short Sale if you think that you are different from large Wall Street Firms that willingly walk away from their obligations. Some people believe that people in debt deserve to work 80 hours a week for the rest of their life until they pay off their debt.

  This one drives me nuts. It is ok for Morgan Stanley to strategically walk away from their obligations on high rise buildings they bought as an investment, but it’s not ok for “Average Joe Homeowner” to walk away from his upside down house?

  What is wrong with the moral compass here? It is ok for a business to re-negotiate their debts with banks, but it is wrong for a homeowner to do it! Are you crazy? Why do banks write off millions in debt for businesses while the homeowners should pay forever and never get a real loan mod?

I guess they figure that homeowners not good business people and will allow the bank to push them around. As you can see, when you run the numbers Short Sales almost ALWAYS make financial sense. Staying in a home that is upside down makes lousy financial sense, unless you get an awesome loan mod. Now those are my opinions, and those points do not apply to every situation. What I am saying is that you really should look at your home as a financial investment, NOT a stone around your neck.

Ventura County Short Sale Help : Bankers, Please Stop Harassing Home Owners For Money They Don't Have

Ventura County Certified Short Sale Specialist, Ventura County Short Sale Help, Certified Short Sale Negotiator, Stop Foreclosure Institute of Ventura County,  Ventura County CA – Maybe this is a pet peeve of mine. Or maybe it just seems ridiculous that someone would call a debtor over and over again asking to be paid, when they have already been told the debtor doesn't have the money to pay them.

Or maybe it is the fact that I see countless examples of debt collectors breaking the Fair Debt Collection Practices Act. But, no one seems to care that they are breaking the law.

The Fair Debt Collection Practices Act forbids collectors from threatening to sue you, but then not following thru and actually filing suit. To get around this rule, they will use language that sounds legal, but isn't.

In one situation, a debt collection firm in Buffalo, New York named their firm Hoffman, Weinberg & O'Brien to make it sound like they were a law firm.

They would then leave messages on people's answering machines. They would say they were with the office of Hoffman, Weinberg & O'Brien and then say they may resort to future legal action.
Or they would say they were calling about a pre-legal matter. In addition, they would reference case number 8306042. If you didn't know any better, you would think the case number was for an actual lawsuit against you. Scary, right?

In addition, if a debtor tells them not to call anymore, then they are supposed to stop calling. They just keep on calling anyways. This is another example of them not obeying the law per the Fair Debt Collection Practices Act?

I allege that they willingly and knowingly break the law repeatedly. This is why we put Number Seven onto the Homeowner's Bill of Rights:

7. Stop the Debt Collector Harassment! The right to tell any and all debt collectors to stop calling and never receive a phone call from then again.

In addition, this would include debt collectors that know the person's phone number, but will call family members in an attempt to embarrass the debtor.

This is America people! Debtor's prison was abolished two centuries ago! It's time to update your activities to the Twenty-First Century!

Or take another example. A homeowner has never made a late payment in their entire life. They lose their job and find one in another state.

The move, try to rent out their house, but can't afford the payments. They get behind on their mortgage payment and credit cards. They enter the world of non-stop harassment.

Debt collectors call them non-stop. These people aren't deadbeats. They are just struggling at the moment. They won't stop calling even when the debtor asks them to stop.

They would pay if they had the money. But they don't have it. But, the people won't stop calling. The constant phone calls make their home life miserable. Don't you think it has gone too far?

I Need Ventura County Short Sale HELP!!: How Much Of My Debt will Be Forgiven When I Short Sale?

"I am upside down on my house. I owe over 700k and I have been told that it is now worth under 400k. I just hate to think how much it will cost me over the long term when you add in the interest I will repay.

I am wondering if my bank will forgive the entire debt in a short sale. What do you think? Kevin."

Here was our answer to Kevin's Question. Most of the short sales we are doing have results in the complete forgiveness of the upside down debt.

There are many different factors involved, such as the law in your state, the bank who has your debt, whether or not you have mortgage insurance, and a number of other factors.

But, in most cases the short sale results in the forgiveness of the debt. In other cases, we have negotiated a 100k debt down to a 13k promissory note.

It's not fun to repay that, but it's much better than repaying the entire debt. I can give you a better answer when I discuss your situation with you. Thinking about a short sale?

Need Ventura County Short Sales Help?: The Bank Won’t Release Me From My Upside Down Debt. What Can I Do?

The Best Short Sale Agent in Moorpark, CA, The Best Short Sale Realtor in Moorpark, CA, The Best Certified Short Sale Specialist in Moorpark, CAVentura County CA – I recently met a realtor who sells properties in a beach town. “Short sales take 9-12 months. The banks are so hard to deal with”, she said.
She mentioned short selling a customer’s property. The sellers were two doctors that had to take a promissory note. The sale was for 900k, so the loss must have been above average.

In this case, her customer’s were ok with a promissory note. But, what if you want to short sale and walk away from the updside down debt?
What can you to do short sell your home without a promissory note. Negotiating short sales on more expensive homes is different than your average short sale.

The most common loan types that will give you a complete release are Fannie Mae, Freddie Mac, FHA, and VA. Most of them won’t loan on a mortgage over $417,000.

There are a few exceptions, but that is the general rule. If your mortgage amount is more than $417,000, then your loan is probably owned by the bank you originally got it from, or it has been securitized.

Many of these loan owners will not grant a release. You will have to use other methods. First, you can tell them that you are broke. If that true, then they may let you off without much ado.

If you have assets, then you will need to use different tactics. You can hire someone to do a “Loan Audit.” This is where they go thru your loan file and search for any violations of lending laws.

Maybe they didn’t give you the proper federally required mortgage disclosures. Maybe the mortgage broker or lending company wasn’t properly licensed. A loan audit will often help your case.

But, it isn’t an “end all, be all”. I’ve seen people promote it as that. Another thing you can do is hire on a good attorney. You will want to deal with someone who is a consumer advocate.

They will know how to use the law to negotiate from a position of power on your short sale. In my opinion, the best way to hire lawyer in this case is on a contingency.

Tell the lawyer, "I will pay you X when you get me what I want." Some people think lawyers drag cases on just to earn more money. Using a payment arrangement like this will help you avoid that.
However, the most important thing you can do is to hire on an experienced short sale agent. Ask them if they have negotiated any short sales where the lender asked for a promissory note.

Then, ask them what they did to negotiate away the promissory note. The good short sale agents will usually know a good attorney. They may have experience dealing with your bank.

Bottom line: They are the person who can point you in the right direction so you can short sale and walk away with a complete release from the debt. Thinking about a short sale?

I Just Can’t Win with my Bank…Why Would I Short Sell My Ventura County Home Instead Of Saving The Monthly Payments & Letting It Go to Foreclosure?

Here is our answer. If you stop paying your mortgage, then you can live in your home rent free for 12-24 months, depending on the state you are located within.

I have seen lenders wait a year after the first missed payment just to file for foreclosure. Yes, you can live in your house for free for a long time. However, a short sale has many advantages over a foreclosure.

It does less damage to your credit and allows you to buy another home in 3 years versus the 5-7 years after a foreclosure. In addition, you can get some money as an incentive for doing the short sale.
If you want the benefits of both, then stay in your home until the foreclosure case has been started. Then, start working on a short sale agent. A short sale can take anywhere from 3 months to even 6-9 months to process.

This will allow you to salvage your credit and live "rent free" for 12-24 months. You will be able to wipe out all that upside down debt and move on with your life.

Here Is A Unique Strategy To Make Ventura County Short Sales Faster & Easier

Today, we are going to lay out a strategy that the short sale sellers can use to help solve this problem.

The biggest reason that this problem can continue is because the realtors assisting you never receive a copy of your home's valuation. If we had copies of those valuations, then holding the people accountable would be much easier.

The banks won't give us the information. And we really don't have the right to it. But, you, the home seller, does have a right to it under the Equal Credit Opportunity Act

Here is what you can do to get your hands on your bank's property valuation.

1. Request a complete itemized payoff from your lender. You do this by faxing them a request. Usually you will get an answer in 7-10 business days.

2. Review the payoff to see where the property valuation is itemized. It will usually be called an "Appraisal" or "BPO." If not, it may be included in some other payoff cost.

3. Since this is part of what you owe on this mortgage, then you have a right to a copy under the Equal Credit Opportunity Act. Fax the lender's legal department a request for a copy of it.

Send a copy of the payoff and circle the spot where you think the BPO payment is. Request a copy for the borrower under the Equal Credit Opportunity Act. In addition, also mail the lender's legal department the same request.

If your lender does not comply, then you can file a complaint with the Federal Trade Commission at www.ftc.gov, The Office of Thrift Supervision at www.ots.treas.gov, The FDIC at www.FDIC.gov, and the Comptroller of the Currency at www.helpwithmybank.gov.

Indicate on your correspondence with the lender that if they do not comply, then you will be filing complaints against them.

Here’s a Ventura County Short Sale Question: Can I Short Sell My Home If I Have More Than One Mortgage and a Lien?


Chris B. Johnson Realtor is a Certified Distressed Property Expert and Certified Pre-Foreclosure Specialist. With a full time staff dedicated to short sale negotiations and transactions, we have been successful with every short sale to date.All the mortgages on the property will have to be satisfied before you can give clear title to the buyer. But the most important negotiation is the one which has to be made with the lenders; which will be two or three in case of multiple mortgages on your home.

Negotiating with two or more lenders might seem to be an intimidating task. But, you do
have a strong negotiating position because second mortgages typically receive nothing if the home is foreclosed by the primary lender.

It is also possible for the first mortgage company to reject a short sale offer if they thinks that they can do better with a foreclosure. Most second mortgages lien on the property is wiped out in a foreclosure.

They will opt for that if the second mortgage is demanding to much money to approve the short sale. A second or third mortgage is called a junior mortgage.

(Third mortgages are rare. We have never seen a fourth mortgage on over 100 short sales we have worked on.)

The junior mortgage received a much smaller percentage of whatever they are owed. Most of them agree to the short sale with them being paid $3,000, and sometimes less than that.

The easiest second mortgage negotiations are short sales of piggyback loans. A piggy back loan is the junior mortgage when a single bank issues two mortgage against the same house.

This was very common during the housing boom. The loan officers at many banks offered this combination to borrowers. The costs were usually lower than getting just one mortgage and the banks agreed to the loans.

This piggy back loan is the second mortgage which is written off by the same lender as of the first mortgage. In this case the realtor or the home owner will be able to negotiate with a single person at the bank that is handling the two loans. Thinking about a short sale?

You can short sell your home and it costs you zero out of pocket. How is that possible? Your bank will pay the realtor for you. Here is how it works.

A seller puts their home up for sale as a short sale. The realtor markets the home to buyers. A price is agreed upon between the seller and buyer.

The price is what the realtor determines would be acceptable to the mortgage company. The mortgage company would rather sell a house as a short sale instead of after foreclosure or bankruptcy.

They agree to pay all the selling costs and the realtor's commission. The seller benefits from salvaging their credit and walking away from the debt.

Get Your Finances Back On Track After A Ventura County Short Sale. Buy Rental Property

Ventura County CA – Buying a rental property can be an excellent long term investment. Some of the wealthiest people I know made their millions from rental properties.

They started with a house and gradually moved up to apartment complexes. But, does it make sense for everyone?

Most definitely not. Rental properties are not for the faint of heart. But, if you have ever considered rental properties now is a great time to get started.
The market is close to the bottom, if not at the bottom. Home prices are increasing in many areas.

For example, St Augustine, Florida, Phoenix, and California have red hot housing markets.
Homes there are selling in days with multiple offers. Home prices are starting to go up in those areas. So, the housing market here may not be increasing yet. But, we expect it to soon.

On the other hand, the rental market has been increasing for a while now. Lots of people lost their home and can't buy another one. We have seen rental prices get bid up with multiple people trying to rent the same home.

The Pros of Rental Property.
The tenant pays your mortgage payment. You won't make a lot
of money while you have a mortgage. But, where else can you have someone buy and pay off something for you?

You start to make real money after the mortgage is paid off. In addition, some properties are so cheap that the rent will pay offa 15 year mortgage. So in 15 years you have a free house.
Rentals are a great hedge against inflation. Notice how gas prices are going up again? The prices of everything else increase with gas prices. Food, clothes, electricity, and everything else goes up.
That means your house will go up in value over the long term. But, you locked in the price when you bought it when prices were lower.

I don't want to make it seem like rental properties are a no brainer. There are some risks involved. No one should buy a rental property unless they are prepared and understand the risks.
