Moorpark Short Sales: How Do You Handle Multiple Offers?

http://www.VCNeighborhoodValues.comMoorpark CA – The Stop Foreclosure Institute recently received a question from another agent. Here was her question.

"I have a short sale listed. At what time in the short sale process do you stop accepting additional offers for submittal to the lender?

If you accept another offer after you've already submitted one to the lender, does it reset your timeline to the beginning? Do you just put them in backup position?

What about the poor buyer whose offer was submitted and has already been waiting for weeks for lender approval? Do you allow them to match the higher offer? You guys have so much experience, how do you handle this? Thanks! Diane."

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Here was our answer. It all depends. We like to stay with the original offer if possible. But, we don't always do that. It all depends on what the seller wants to do. If the bank is asking for a deficiency or promissory note, then the seller may want to submit the higher backup offers. We run this for the sellers and not the buyers benefit.

We feel that it is our job is to represent the seller. If the short sale lender does not like the first offer, then we will submit the next offer. But, if they accept the first offer, then we recommend that the seller go with that one to honor the first buyer. That buyer has waited the longest and deserves to be rewarded for their patience.

Ventura County Short Sale HELP!! The National Mortgage Debt Relief Act Expired At The End Of 2013, Is It Too Late to Short Sell My Home?

http://rapcoop.rapmls.com/scripts/mgrqispi.dll?APPNAME=rapcoop&PRGNAME=MLSLogin&ARGUMENT=sy3vDBZIknTGrZP3dJ2A3aXwz6inZzxxjTb0QLlW%2FvWbCE3lM0q9LlEtSxx2VXNvzkGDuRHXtH9kXeimjylh%2BA%3D%3D&KeyRid=1
By Chris B Johnson, Realtor. Prior to 2007, short sales were NOT very appealing to home owners in hardship due to the fact that the borrower could be liable to pay taxes on any money forgiven by their lender. The Mortgage Forgiveness Debt Relief Act came to be law on December 20th, 2007.
This important act was great news and gave most home owners in hardship the chance to sell their property as a short sale, and NOT be have to pay income taxes on the money forgiven them by their lender.
The BAD News is, this act expired at the end of 2013. The GOOD NEWS is the IRS and the California State FTB have extended the benefits of the Mortgage Forgiveness Debt Relief Act!! So if you live in the State of California, It is NOT too late.
Are there still homeowners out there that could benefit from a Short Sale? Well, the number of Homeowners in California who have more than 10 percent equity in their residence went up 2.3 percent, or nearly $120,000, in February. The decline in negative equity is certainly good news, but, it is important to keep in mind that 1.2 million California homeowners, or 13.9 percent, remain underwater and will continue to create significant headwinds for the California housing market recovery. Couple this with increase home prices and increasing interest rates, and you can see it will be more difficult for a lot of buyers.
February was another month with lackluster home sales, and the fifth in a row where sales fell short of the same month a year earlier. The March-through-May data will give us a better sense of what's been holding back activity the most – supply constraints or the double-whammy of higher prices and higher mortgage rates. The drop in housing affordability is enough to nudge some out of the market. Other would-be buyers have no doubt called ‘time out’ while re-evaluating their housing priorities, or watching for signs the market has overshot a sustainable price level.

The economy is growing, creating jobs. People who lost homes to a short sale or foreclosure over the last eight years will be looking to buy again. On the supply side, inventory is increasing, as it normally does this time of year, but so far there hasn’t been an explosion of new listings, and new-home construction is still well below average.

Moorpark Short Sales: Who is in charge during a short sale?

Stop the Foreclosure Auction Moorpark CA – Many home buyers think that the short sale lender is in charge during a short sale. Nothing could be further from the truth. The short sale lender can only veto short sale offers. They can’t put the property up for sale or decide who to sell it to.

Only the home owner can do that. Why is that? Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Until the lender forecloses on the home the home owner is in the driver’s seat. They “own” the property until the lender forecloses. We have had many buyers get angry that a home owner would not accept their lowball offer. “You have to submit my offer to the lender. If you don’t then that would be fraud”, they tell the home owner. You, the home owner are in charge.

That means that you can make the following decisions. You are allowed to pick the buyer’s offer that you think the lender will be most likely to accept. You are allowed to turn down offers that you don’t like for whatever reason. (Maybe the buyers are too picky about the home and want you to make repairs.) You are allowed to turn down offers if the buyer is not pre-approved for a loan. In addition, you can ask the buyer to inspect the property before they write a contract. You are allowed to ask for an earnest money deposit to make sure the buyer is serious about the house. It is your right to do these things for as long as you own the property.

Don’t let anyone tell you otherwise.

Moorpark Short Sale Question: How Can I Buy Another Home Right After A Short Sale?

YOUR BEST REAL ESTATE AGENT SERVING MOORPARK CA, Your Moorpark Certified Short Sale Specialist. Loan Modification Denied? HARP re-fi denied? Want to avoid foreclosure? Moorpark’s Top Listing Realtor with Prudential California Realty. http://bit.ly/14WW3B0Ventura County CA – The biggest advantage a short sale has over a foreclosure is that you can buy your next home much sooner.
Under current lending guidelines, you can buy another home in 3 years after a short sale. After a foreclosure you have to wait 5-7 years in most cases.

(FHA’s current guidelines state that you can get an FHA loan immediately after a short sale, provided that you never missed a payment. If you were in default at the time of the short sale, then you have to wait 3 years before they will approve your loan.)

But, what if did miss a payment and you want to buy another home sooner than that?

There are loopholes in the Fair Credit Reporting Act. Remember, the law was written to protect consumers. It wasn’t written to protect the lenders!

You can use the law to your advantage to get a short sale removed from your credit history. Then, you can fix any other negatives on your credit report.

After that, your credit should be good enough to qualify to buy another home.

Here is why you can have the short sale removed from your credit report. The Fair Credit Report Act requires lenders do certain things before reporting negative credit.

If you lender misses any of these steps, then they are not allowed to post that item to your credit report. Don’t kid yourself; the lenders make mistakes like this all the time.

They are more concerned with getting paid than making sure every credit report is done perfectly. A good lawyer that specializes in this can help you.

They will know the intricacies of the law and help you get the short sale removed from your credit so you can buy another home. Thinking about a short sale?

Step 7 To Fix Your Credit After A Ventura County Short Sale: The Waiting Period

boredVentura County CA – The next step in the process of getting a cleaned up credit report, is the one that takes the least effort, but the most patience: WAITING.

You’ve done your part to get the ball rolling, and now the credit reporting companies have to do their part.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

What happens during this phase is that the credit reporting agencies have 30 days to investigate. I use the term loosely here because the methodology that they use is not very investigatory. They take the claims and whittle the dispute down to a 2 digit code that gets checked against a reporting database called eOscar for verification.

They are afforded 30 days to do this step, unless the person disputing has gotten their credit report from annualcreditreport.com which allows them to take 45 days to check out your dispute (remember back in an earlier step where this was discussed – this isn’t the site to get your credit from!.)

While you wait, remember that whatever your credit score was before you began this process, you should be doing things now to improve it. What I mean by this is that while waiting for the history part of your credit report to be cleaned up, you work on the future of the credit report. Take action now to build a better situation.

First, keep your report clean from this moment forward. Don’t tarnish it beginning now. Do not have a single late payment – pay your bills on time. I know, it’s easier said than done, but it will be important in your future that you did this today. Don’t have any new collection accounts or charge offs.

Don’t, REALLY don’t, get new inquiries on your credit report – this means don’t open any new credit cards, store charge cards. No applying for everything that sounds like a good idea. Don’t close any open credit cards. Pay off the credit card - yes, but close out the account – no.

Keep this length of history long on your report. And, just wait. The 30 days for the credit bureau investigation will fly by. Once their 30 days is up, they have 5 additional days to provide you with their findings. If anything in their investigation was not verifiable, that item is required to be removed from your credit report.

They will also send you an updated credit report. So, watch for their letter to you in your mailbox after you complete the WAITING step. Thinking about a short sale? I can help you short sale your property and get back on your feet.

How Do You Negotiate A Ventura County Short Sale With A HELOC Loan ?

Your Ventura County Short Sale Specialist recently recieved the following question, “What is your experience with HELOCs? I have a HELOC that is a 2nd mortgage. The first mortgage will give them 6% or approximately $3000. The HELOC is saying that they want 30% ($30,000.) They won't budge. They want this in CASH, not as a promissory note (in case the seller does a bankruptcy.) They are telling me they will just let the house foreclose because that is the lender's policy now. What do you recommend that I do?”

Here was our answer to the question. Most third party collection agencies are very tough to negotiate with. They are completely unreasonable. They are so trained to give ultimatums that they will not budge, no matter how much logic and common sense you bring to them.

Here is what you can do. Go around them. Contact the CEO. We have been able to contact the CEO of many different lenders. Show them that they will receive less in a foreclosure than the $3,000 available now. Hopefully they will tell the collection agency to approve the $3,000 deal.

Ventura County Short Sale HELP, Do I Have To Be Behind On Payments Before My Lender Will Approve My Ventura County Short Sale?

Your BEST CHOICE FOR A REAL ESTATE AGENT SERVING VENTURA COUNTY CA, The Best Short Sale Agent in Ventura County, CA, The Best Short Sale Realtor in Ventura County, CA, The Best Certified Short Sale Specialist in Ventura County , CA, Your Top Listing Realtor with Prudential California Realty.Ventura County Short Sale Help – The laws keep changing, so it can be difficult to keep track of who allows what. Usually, the best place to start is researching who owns your loan??

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Many homeowners have short sold their home and never missed a payment. The lenders will approve a short sale where the seller has not missed a payment when the following is in place.

1. The homeowner owes more on their home than it is worth.

2. The homeowner has a verifiable hardship that will force them to miss their payments in the near future. In these cases, the lenders know it is better to liquidate the home as quickly as possible.

A faster sale will reduce their losses on interest and property taxes. In addition, an owner occupied home usually sells for much more than a vacant home. Sure, the lenders don't like short sales. They hate losing money. (Don't kid yourself.)

But, they know that when a loss is inevitable, then it is best to do what they can to reduce the loss as much as possible. That is why they will approve short sales when the homeowner hasn't missed a payment yet. In fact, they will probably even negotiate loan modifications with homeowners who haven't missed a payment either.

If you accept our offer to help you on a short sale, your lender may not agree to a short sale or to modify your loan. We do offer a loan modification kit. However, the likelihood of negotiating a modification is like everything else in life. It takes work and persistence to convince your lender to modify your loan. No matter what you or we do, your lender may not approve a loan modification. We do not recommend that you stop paying your mortgage, because this will cause damage to your credit and could cause you to lose your home. Because we know avoiding foreclosure is so important to any homeowner, we recommend that you speak with the appropriate legal or tax advisor before making any decision. This is not intended as legal, technical, or tax advice. Please speak with a licensed professional before making any decision. Information is deemed reliable but not guaranteed as of the date of writing. You have the option to reject a short sale or loan modification from your lender if it does not meet your approval. If you decide not to go thru with the short sale, then you do not have to pay us our fee. We normally make a real estate sales commission for helping you on a short sale. Here’s a Ventura County Short Sale Question: Can I Short Sell My Home If I Have More Than One Mortgage and a Lien?

Chris B. Johnson Realtor is a Certified Distressed Property Expert and Certified Pre-Foreclosure Specialist. With a full time staff dedicated to short sale negotiations and transactions, we have been successful with every short sale to date. All the mortgages on the property will have to be satisfied before you can give clear title to the buyer. But the most important negotiation is the one which has to be made with the lenders; which will be two or three in case of multiple mortgages on your home.

Negotiating with two or more lenders might seem to be an intimidating task. But, you do
have a strong negotiating position because second mortgages typically receive nothing if the home is foreclosed by the primary lender.

It is also possible for the first mortgage company to reject a short sale offer if they thinks that they can do better with a foreclosure. Most second mortgages lien on the property is wiped out in a foreclosure.

They will opt for that if the second mortgage is demanding to much money to approve the short sale. A second or third mortgage is called a junior mortgage.

(Third mortgages are rare. We have never seen a fourth mortgage on over 100 short sales we have worked on.)

The junior mortgage received a much smaller percentage of whatever they are owed. Most of them agree to the short sale with them being paid $3,000, and sometimes less than that.

The easiest second mortgage negotiations are short sales of piggyback loans. A piggy back loan is the junior mortgage when a single bank issues two mortgage against the same house.

This was very common during the housing boom. The loan officers at many banks offered this combination to borrowers. The costs were usually lower than getting just one mortgage and the banks agreed to the loans.

This piggy back loan is the second mortgage which is written off by the same lender as of the first mortgage. In this case the realtor or the home owner will be able to negotiate with a single person at the bank that is handling the two loans. Thinking about a short sale?
