The Moorpark Short Sale Market has been pulling back and prices have recently flattened. Demand measured by the Market Action Index is increasing and days-on-market is holding steady. With more properties coming available, conditions are mildly positive. In the last few weeks the market has achieved a relative stasis point in terms of sales to inventory. However, inventory is sufficiently low to keep us in the Seller's Market zone so watch changes in the MAI. If the market heats up, prices are likely to resume an upward climb.

Ventura County CA – Here are a few things you should not be surprised to see crop up during the short sale process.
Unscruplous Debt Collection Tactics. If you are facing financial hardship, then paying credit cards and other unsecured debts is your lowest priority. An unsecured debt is a debt where they can’t take away your car or house. A secured debt has something as collateral, such as your car, house, or anything else of value.
The most commons unsecured debt is a credit card. When you stop paying them, they will call you nonstop. The reason is because they don’t have any other way to collect from you.
They can’t come get your car or take your house. So, they make up for that by blowing up your phone with harassing calls. In addition, they use deceptive tricks to get you to pay them.
For example, there are Federal Laws that regulate what they can do or say. They aren’t allowed to threaten to sue you, but then not follow thru and actually file suit.
To get around this rule, they will use language that sounds legal, but isn’t. In one situation, a debt collector in Buffalo, New York named their firm Hoffman, Weinberg & O’Brien to make it sound like they were a law firm.
They would then leave messages on people’s answering machines. They would say they were with the office of Hoffman, Weinberg & O’Brien and then say they may resort to future legal action. In addition, they would reference case number 8306042.
If you didn’t know any better, you would think the case number was for an actual lawsuit against you. That is scary. Don’t you agree?
Most credit card accounts never sue (despite the constant threats.) Even when they do sue and get a judgment, they rarely ever attempt to garnish wages.
A lot of judgments expire without getting paid. But, a lot of them get paid off when a person’s income increases, or that person sells a valuable asset such as a house.
It might seem like the process takes a long time. Some short sales only take a few months. Before you know it you are moving out of your house and onto the next place.
However, some short sales will take a lot longer. We have some files that we have been working on for a year or even longer.
It’s not the end of the world. Just stay put and keep on saving the money you would be using for rent. In most cases the short sale will eventually be approved and you can move on with your life.
Your lender may attempt to collect money from you when they aren’t legally entitled to do so. We have heard several stories of some lenders asking for a promissory note when the state the property was in did not allow the lender to pursue the homeowner after a short sale.
The stories in question were for short sales of properties in California and Washington. Don’t sign a promissory note a lender sends you after a short sale when you are in a non-recourse state.
Talk to a lawyer to see if you are obligated to repay the debt. You could probably get out of repaying it if you tried. Thinking about a short sale?

Moorpark CA – Many home buyers think that the short sale lender is in charge during a short sale. Nothing could be further from the truth.
The short sale lender can only veto short sale offers. They can’t put the property up for sale or decide who to sell it to.
Until the lender forecloses on the home the home owner is in the driver’s seat. They “own” the property until the lender forecloses.
We have had many buyers get angry that a home owner would not accept their lowball offer. “You have to submit my offer to the lender. If you don’t then that would be fraud”, they tell the home owner.
You, the home owner are in charge.
That means that you can make the following decisions.
You are allowed to pick the buyer’s offer that you think the lender will be most likely to accept.
You are allowed to turn down offers that you don’t like for whatever reason. (Maybe the buyers are too picky about the home and want you to make repairs.)
You are allowed to turn down offers if the buyer is not pre-approved for a loan. In addition, you can ask the buyer to inspect the property before they write a contract.
You are allowed to ask for an earnest money deposit to make sure the buyer is serious about the house.
It is your right to do these things for as long as you own the property.
Don’t let anyone tell you otherwise.

Ventura County CA – The next step in the process of getting a cleaned up credit report, is the one that takes the least effort, but the most patience: WAITING.
You’ve done your part to get the ball rolling, and now the credit reporting companies have to do their part.
What happens during this phase is that the credit reporting agencies have 30 days to investigate.
I use the term loosely here because the methodology that they use is not very investigatory. They take the claims and whittle the dispute down to a 2 digit code that gets checked against a reporting database called eOscar for verification.
They are afforded 30 days to do this step, unless the person disputing has gotten their credit report from annualcreditreport.com which allows them to take 45 days to check out your dispute (remember back in an earlier step where this was discussed – this isn’t the site to get your credit from!.)
While you wait, remember that whatever your credit score was before you began this process, you should be doing things now to improve it.
What I mean by this is that while waiting for the history part of your credit report to be cleaned up, you work on the future of the credit report. Take action now to build a better situation.
First, keep your report clean from this moment forward. Don’t tarnish it beginning now. Do not have a single late payment – pay your bills on time.
I know, it’s easier said than done, but it will be important in your future that you did this today. Don’t have any new collection accounts or charge offs.
Don’t, REALLY don’t, get new inquiries on your credit report – this means don’t open any new credit cards, store charge cards. No applying for everything that sounds like a good idea.
Don’t close any open credit cards. Pay off the credit card - yes, but close out the account – no.
Keep this length of history long on your report.
And, just wait. The 30 days for the credit bureau investigation will fly by. Once their 30 days is up, they have 5 additional days to provide you with their findings.
If anything in their investigation was not verifiable, that item is required to be removed from your credit report.
They will also send you an updated credit report.
So, watch for their letter to you in your mailbox after you complete the WAITING step. Thinking about a short sale?

This information on Step 7 To Fix Your Credit After A Ventura County Short Sale: The Waiting Period is provided as a courtesy to our viewers to help them make informed decisions.
Moorpark, CA – The next step in your credit repair process is a very important one. This is the time where you check the results of your efforts so far.
The credit bureaus have now sent you their results, including a new credit report and a letter telling you what has changed on the report based on your disputes.
Don’t just read what they sent and file it away! Make a copy of it, and have it ready to file.
Take out your file that has the original copy of your credit report and put it side by side with the new report. Take out your copy of the letter you originally sent to the bureau that laid out all the things you were disputing.
Go through and compare these disputes against their updated credit report.
Their summary might say that an item was investigated but was verified, and so it still shows on your credit report, and wasn’t removed.
They won’t say more than, “item verified.”
This could discourage you, but what folks who’ve been down this road before you will tell you is that no one called the original information provider to verify the item – that they used that eOscar dataset to check it out.
If they “verified” something on your credit report which clearly isn’t yours:
Call the toll-free number at the top of the report
Tell them your report reference number and ask for “the method of verification per FCRA (Fair Credit Reporting Act) Section 611 (a) (7).
If they say they called the original creditor, ask them for the phone number of the original creditor.
Call the original creditor and ask for the records yourself.
If they say the records are not available, call the credit reporting agency back at their number from the results report and tell them that the original creditor has no records, and that they need to open another dispute – provide them with the name and number of the person you just talked to at the original creditor.
This sounds like a lot of hassle, but it’s worth the extra effort.
On the other hand – you might find in your new reporting from the credit bureaus that the disputed item was investigated and the listing was found to be inaccurate or unverifiable!
If this is the case, the negative listing will either be deleted from your report all together or it will go from being a negative to being a positive. This is great news for you!

Ventura County Short Sale Help – The laws keep changing, so it can be difficult to keep track of who allows what. Usually, the best place to start is researching who owns your loan??
Many homeowners have short sold their home and never missed a payment. The lenders will approve a short sale where the seller has not missed a payment when the following is in place.
1. The homeowner owes more on their home than it is worth.
2. The homeowner has a verifiable hardship that will force them to miss their payments in the near future.
In these cases, the lenders know it is better to liquidate the home as quickly as possible.
A faster sale will reduce their losses on interest and property taxes.
In addition, an owner occupied home usually sells for much more than a vacant home. Sure, the lenders don't like short sales.
They hate losing money. (Don't kid yourself.)
But, they know that when a loss is inevitable, then it is best to do what they can to reduce the loss as much as possible.
That is why they will approve short sales when the homeowner hasn't missed a payment yet. In fact, they will probably even negotiate loan modifications with homeowners who haven't missed a payment either.

Ventura County CA – The Stop Foreclosure Institute recently received a question from Jennifer. She is having a hard time selling her home.
“I have had my house for sale for a little while, but it hasn’t sold. No buyers have come to look at it. At first I thought the price was fair.
But, now that no one has come to see the home, I am beginning to realize that I am upside down. My realtor hasn’t talked to me about a short sale. What should I do?” Jennifer asked.
Here is what we recommended to her. First, talk to your current agent about a short sale. The might be uncomfortable with bringing it up.
Short sales are a sensitive issue. Some people get offended when you ask them about a short sale. It doesn’t look like that is the case with you.
Tell your agent that you think you might be upside down. Ask them what they think they can realistically sell the house for in today’s market.
Then, ask them for a “Net Sheet.” This is a sheet that details all of the costs and fees associated with selling a home.
The fees and costs are subtracted from the sales price to give you the net amount you will receive from the sale. Compare that number with your mortgage payoff.
If it is less than what you owe your lender, then you will need to consider a short sale. Ask your agent if they can handle your short sale.
If not, then you may need to hire someone else. Short sales are a lot more complex than a normal real estate transaction.
Make sure the person you interview has closed short sales in the past and knows what they are doing.
Ask them how the short sale process works. Have them explain it to you. This will help you determine if that person can do the job for you. Thinking about a short sale?

Ventura County CA – Realtors have a very important role when it comes to helping sellers short sell their homes. It is the realtor who works to attract the purchaser by communicating with buyers and their realtor.
The seller’s agent and the buyer’s agent often have to negotiate to come up with a consensus that is acceptable to both clients. Getting everyone to come to a mutual agreement is not an easy task for realtors.
Realtors get stressed out because of the task that is placed upon their shoulders.
They have to look for buyers, help the seller come up with a good hardship letter, deal with a buyer’s realtor, and basically do everything they can to help with the short sale.
The seller’s realtor has to analyze various offers and send these to the lender (or the bank) and wait for them to respond to the offer that is sent to them.
Sometimes all the effort is in vain when a buyer decides that they are not interested in buying the home anymore.
Often buyers agree to buy a short sale property but then, never get back to the seller or to his realtor. Then the realtor has to find out whether or not the buyer is still willing to buy the seller’s house.
I recently met a realtor in a another town. “I hate short sales", she told me. "They are frustrating and take forever. Most of mine have dragged out for 9-12 months. The short sale lenders are so tough to work with.”
Apparently this agent does not specialize in short sales. Neither do a lot of the other agents that complain about them.
These agents openly admit they hate short sales. They say stuff like, "Maybe lenders worry about what would happen if they approved too many short sales."
They haven't taken the time to learn how they work. They don't know who owns the loan, or their short sale requirements. (This is all readily available information for anyone who has an internet connection.)
Maybe these agents have chosen to specialize in other area of the real estate business, such as new construction or first time home buyers.
Or they specialize in commercial property. All of a sudden they want to short sale your house. Where does that put your odds of a successful short sale?

Ventura County CA – Are you upside down on your mortgage? Try this. Sit down and run the numbers. How much will your upside down mortgage cost you over the next 30 years?
Let's say a homeowner bought a house 4 years ago for $600,000. Today, their house is only worth $400,000. In addition interest rates have dropped since then.
And, because they have "Jumbo Loan", they are paying a higher interest rate than someone who bought a less expensive house.
Let's run the numbers. The payment on a $600,000, 7% interest rate over 30 year mortgage is $3,991.81. Even worse, that homeowner will repay $1,437,051. That's a lot of money!
Now, let's compare this with the guy buying the home next door. He is paying $375,000 f
or the home because it is a pre-foreclosure sale.
His interest rate is 4.25%, because he is able to lock in today's low interest rates. The payment on his $400,000, 4.25% interest rate over 30 year mortgage is $1,844.77. But, it gets worse.
The neighbor next door is only going to repay $664,117 over the next 30 years. He is paying less than half of what his neighbor is paying for his house.
It just doesn't make sense to hold on if you're struggling to repay a huge upside down mortgage.
