Moorpark Hyperlocal Short Sale Trends, Has the Moorpark Short Sale Market Been Pulling Back?

The Moorpark Short Sale Market has been pulling back and prices have recently flattened. Demand measured by the Market Action Index is increasing and days-on-market is holding steady. With more properties coming available, conditions are mildly positive. In the last few weeks the market has achieved a relative stasis point in terms of sales to inventory. However, inventory is sufficiently low to keep us in the Seller's Market zone so watch changes in the MAI. If the market heats up, prices are likely to resume an upward climb.

Ventura County Short Sale HELP!! Buying A Short Sale In Simi Valley or Thousand Oaks or Moorpark? Are You Sure You Are Ready??

 If you are a first time buyer, you may have the time and patience needed for a probate or short sale in Moorpark, Simi Valley or Thousand Oaks.

  What if your FICO score is not "Perfect"? Well, go back to the top and realize there is still hope. One Third of consumers have a FICO score below 650, according to Carrington Mortgage.

The lender is refocusing its business on targeting the underserved segment and eliminating conventional and jumbo loans. It is limiting its acceptance of wholesale submissions with FICO scores above 680 starting April 1, except for VA loans, HousingWire reports. Carrington Mortgage Services is the latest company to announce that it has lowered its minimum FICO score to 550.

It also has expanded guidelines on several FHA, VA, and USDA loan programs to aid those with FICO scores below 640. Wells Fargo, the nation’s largest mortgage lender, said in February that it was lowering its minimum FICO score requirements on FHA-backed mortgages from 640 to 600.

The move, bank officials said, was aimed at “opening up our credit box more.”

Ventura County-Moorpark Short Sales: I Am Current On My Mortgage, Can I Short Sale My Upside Down Home?

 – Moorpark Short Sale Specialist recently received a question from Brent. Here is Brent's Question.

 "If we are not behind on our mortgage but can't sell our home through a normal sale because we don't have any equity, can we still qualify for a Moorpark short sale? We would like to sell this property and get another property where we are not upside down. Thank you!” asked Brent.

Here was our answer. Brent, there is actually a federal short sale program that encourages what you would like to do. It is called the FHA 4155 loan program. It allows a person that is short selling their house to buy another one right away. However, there are a few caveats.

We have been told that you will need the following. (Guidelines can change at any time, so make sure you check them with a Mortgage Professional familiar with the program.)

 A)  A 640 FICO credit score or better.
 B) You must be current on all installment payments and on your mortgage.
 C) No bankruptcy or foreclosure on your credit in the last 7 years.
 D) The home you are purchasing must be inferior to the one you are selling.

I don’t know the exact guidelines, but I think it means it is a smaller home, or it has less bedrooms or a lower price.

 E) You will need the 3.5% down payment for the new purchase. The biggest hurdle will be getting your current lender to approve the short sale.

Most lenders will approve a short sale. It just takes time and a little patience. But, it is a great opportunity to move on from your upside down property and start building equity elsewhere.

Why Short Sale Lenders Back Off When Threatened With Bankruptcy

A bankruptcy filing can stall their ability to foreclose by 6 months, and sometimes as long as a year.

 The lenders know that most bankruptcies will cause them to lose the ability to pursue you for any losses. This means they can’t go after you for any upside down debt. The only thing a lender gets in a Chapter 7 Bankruptcy is any collateral they have on a loan.

So they can foreclose on your house, but that is about the only thing they can do. They can’t garnish your wages or bank accounts. So use the bankruptcy threat in your negotiations. Lenders know how much it will hurt their ability to collect from you.

 The most effective technique that we have seen is to have all negotiations go thru a bankruptcy lawyer. The lawyer knows how to negotiate from a position of power. The lawyer will also know full well exactly how bankruptcy will hurt the lender. Even if you have no intention of declaring bankruptcy the lender will get scared and cave in. Then you can get the loan modification you deserve.

Bank of America, Chase, and several other lenders need to improve their response times. But, they won't do it without some prodding. They have the resources available to make the changes. How Do You Negotiate A Ventura County Short Sale With A HELOC Loan ?

Your Ventura County Short Sale Specialist recently recieved the following question, “What is your experience with HELOCs? I have a HELOC that is a 2nd mortgage. The first mortgage will give them 6% or approximately $3000. The HELOC is saying that they want 30% ($30,000.) They won't budge. They want this in CASH, not as a promissory note (in case the seller does a bankruptcy.) They are telling me they will just let the house foreclose because that is the lender's policy now. What do you recommend that I do?”
 
 
Here was our answer to the question. Most third party collection agencies are very tough to negotiate with. They are completely unreasonable. They are so trained to give ultimatums that they will not budge, no matter how much logic and common sense you bring to them.
 
Here is what you can do. Go around them. Contact the CEO. We have been able to contact the CEO of many different lenders. Show them that they will receive less in a foreclosure than the $3,000 available now. Hopefully they will tell the collection agency to approve the $3,000 deal.

Many homeowners have short sold their home and never missed a payment. The lenders will approve a short sale where the seller has not missed a payment when the following is in place.

1. The homeowner owes more on their home than it is worth.

2. The homeowner has a verifiable hardship that will force them to miss their payments in the near future. In these cases, the lenders know it is better to liquidate the home as quickly as possible.

A faster sale will reduce their losses on interest and property taxes. In addition, an owner occupied home usually sells for much more than a vacant home. Sure, the lenders don't like short sales. They hate losing money. (Don't kid yourself.)

But, they know that when a loss is inevitable, then it is best to do what they can to reduce the loss as much as possible. That is why they will approve short sales when the homeowner hasn't missed a payment yet. In fact, they will probably even negotiate loan modifications with homeowners who haven't missed a payment either.

Need Ventura County Short Sales Help?: The Bank Won’t Release Me From My Upside Down Debt. What Can I Do?

The banks are so hard to deal with”, she said.
She mentioned short selling a customer’s property. The sellers were two doctors that had to take a promissory note. The sale was for 900k, so the loss must have been above average.

In this case, her customer’s were ok with a promissory note. But, what if you want to short sale and walk away from the updside down debt?
What can you to do short sell your home without a promissory note. Negotiating short sales on more expensive homes is different than your average short sale.

The most common loan types that will give you a complete release are Fannie Mae, Freddie Mac, FHA, and VA. Most of them won’t loan on a mortgage over $417,000.

There are a few exceptions, but that is the general rule. If your mortgage amount is more than $417,000, then your loan is probably owned by the bank you originally got it from, or it has been securitized.

Many of these loan owners will not grant a release. You will have to use other methods. First, you can tell them that you are broke. If that true, then they may let you off without much ado.

If you have assets, then you will need to use different tactics. You can hire someone to do a “Loan Audit.” This is where they go thru your loan file and search for any violations of lending laws.

Maybe they didn’t give you the proper federally required mortgage disclosures. Maybe the mortgage broker or lending company wasn’t properly licensed. A loan audit will often help your case.

But, it isn’t an “end all, be all”. I’ve seen people promote it as that. Another thing you can do is hire on a good attorney. You will want to deal with someone who is a consumer advocate.

They will know how to use the law to negotiate from a position of power on your short sale. In my opinion, the best way to hire lawyer in this case is on a contingency.

Tell the lawyer, "I will pay you X when you get me what I want." Some people think lawyers drag cases on just to earn more money. Using a payment arrangement like this will help you avoid that.
However, the most important thing you can do is to hire on an experienced short sale agent. Ask them if they have negotiated any short sales where the lender asked for a promissory note.

Then, ask them what they did to negotiate away the promissory note. The good short sale agents will usually know a good attorney. They may have experience dealing with your bank.

Bottom line: They are the person who can point you in the right direction so you can short sale and walk away with a complete release from the debt. Thinking about a short sale?
