Loan Modification HELP!! Here’s What Borrowers Facing Resets Can Do

 Fannie Mae and Freddie Mac have offered several possible solutions for borrowers who received modifications through the government’s Home Affordable Modification Program (HAMP) who are facing increased monthly payments when the interest rates on their modifications reset, according to the FHFA’s 2015 Annual Report to Congressreleased on Wednesday.
The government launched HAMP in February 2009 in response to the crisis as a way for delinquent borrowers to avoid foreclosure. Since then, the program has helped approximately 1.8 million families and completed approximately 2.3 million homeowner assistance actions. HAMP is set to expire at the end of this year.
Under the terms of HAMP, five years after receiving a modification, homeowners will see the interest rate increase by 1 percentage point each year until it reaches the market rate in place at the time they received their modification. According to Treasury, the typical HAMP homeowner will experience two to three step-ups; the nationwide median payment increase after the first step-up is $93, while the median payment increase after the final step-up is around $206.
According to the FHFA’s annual report to Congress, in January 2015, the Agency directed the GSEs to implement a $5,000 pay-for-performance incentive to reduce the outstanding principal for HAMP borrowers who have remained in good standing through the end of the sixth year of their modification. The FHFA then made two changes to its Streamlined Modification products; in March, the period of time for which a borrower who recently experienced an interest rate reset must have been delinquent in order to receive a modification was reduced from 90 days to 60 days, and then in May the sunset date for all Streamlined Modification products was eliminated.
“One of the reasons for ensuring the continuing availability of this loss mitigation tool is its role as a solution for HAMP borrowers who face rate resets,” FHFA said in its report.
Also according to FHFA, during 2015 Fannie Mae and Freddie Mac identified approximately 16,000 HAMP borrowers facing resets who were eligible for a refinance through the government’s Home Affordable Refinance Program (HARP), which is also set to expire at the end of 2016. The GSEs provided servicers with information that would enable them to solicit these borrowers for HARP, according to FHFA.
Treasury has been monitoring HAMP data closely and has created a three-pronged safety net to help borrowers should they struggle with a step-up to avoid re-defaulting. The prongs are one, requiring servicers to notify borrowers at two separate time points that a step-up is imminent (no less than 120 days from first rate increase and at least 60 days prior to first increase); the second is introducing post-modification counseling for borrowers who are at risk of re-default and have missed a payment; and the third is an enhanced suite of tools which include increased incentives for remaining current and improved HAMP Tier 2 modification options.

Ventura County Short Sale - Will I Still Have To Pay Property Taxes If I Do A Ventura County Short Sale?

 The Stop Foreclosure Institute recently received a question from Paul. Here is Paul's Question. "I am thinking about a short sale, but I am behind on my property taxes. Will I still have to pay them if I short sale my home? Max." 
  Here is the answer to Paul's Question: In most cases your lender will pay those property taxes. Property taxes are a first priority lien on a property. That means that if a property is foreclosed upon, then they still have to be paid. They don’t go away for any reason. 
 This is also why most lenders want to charge you monthly and then pay the property taxes themselves. They know that the taxes are a big bill that only comes once a year. Not everyone can afford that big bill. 
Because your lender knows they will still have to pay the taxes after a foreclosure, they are willing to pay them during a short sale. A foreclosure is a liquidation of the property to simply get what they can and move on. 
A short sale has been proven to net them more money than a foreclosure. So if they are liquidating the property, why net more money from the sale with a short sale and avoid a foreclosure? That’s why they will pay the taxes when you short sale. 
 Every short sale the Stop Foreclosure Institute has sold resulted in the lender paying the property taxes that were owed. In some cases they paid 2-3 years of property taxes.

Short Sales - Does My Ventura County Short Sale Have To Be Approved Before I Put It Up For Sale?

We often get asked if a short sale is even worth the effort. “Do I need to have my short sale “Approved” by my lender before I put my home on the market?”

One seller asked us. “When I called my lender they wouldn’t talk to me about my short sale. I am concerned that they might do that when I finally sell the property and I’ll never get the short sale approved.”

 Here was our answer. Most lenders will not talk to you about a short sale until you have several things in place. They want a solid offer from a pre-qualified home buyer along with all the necessary financial documents.

Why do they do this? Because they only want to process short sales that will sell and close. Now, I think it’s an inefficent way to do things. Instead of refusing to negotiate short sales until there is an offer on the table, they should instead pre-approve short sales. It would make the process so much easier.

A home could be placed on the market at a set price. Buyers would be more interested in the property because they know they can get an answer in 2-3 days versus 2-3 months.

We have brought this up with Matt Vernon, the Vice President of Bank of America’s Short Sale Department. He knows there is stuff to improve. But, it’s hard to change the course of a huge company with so many different parties involved.

Despite all this, experienced short sale agents are getting short sales approved every day. The Short Sale Process is getting better and easier to navigate. More and more lenders are moving towards “Approved” Short Sales.

You just need to find a good short sale realtor that can navigate their way thru the crazy short sale process.

Step 3 To Fix Your Credit After A Ventura County Short Sale: Rank Items In Order Of Importance

Get your Free Report for All Your Options HERE: http://hosted.cdpe.com/175202/">Certified Distressed Property ExpertVentura County CA – The next step in going over your credit reports is to really rank the items being reported about you to find ones that are the most negative. Rank the negative items with the MOST negative ones given the lowest ranking.
You want to rank the ones that will cause the most damage to your credit score.
Here are the most damaging items (in order of damage amount): bankruptcy; foreclosure; repossession; loan default; court judgment; accounts in collections; payments that are past due; payments that are late; being denied credit; inquiries to open new credit.
One thing to note about disputing things on your credit report – items like court judgments and foreclosures and child support arrears are verified by a different system, and are rarely if ever disputable.
Here is one of the best suggestions that I have seen work well. Take a Sharpie pen, and mark on the unused copy of your report.
Circle the items you are disputing and write a SHORT note about why you are disputing that item – for example “Not my account” or “Not Late.”
I am not advising you to lie or make misleading statements when you write to the credit reporting company. However, I will tell you that if someone is reporting something about you, they should be able to prove that what they are saying is the truth.
The credit bureaus are required to check out and investigate all the disputes they get that are deemed to not be “frivolous or irrelevant.”
What that means is that you need to not dispute every single item on your report right now, and you need to be taken seriously.
This means DO NOT use the dispute form that they sent with your credit report. They see those forms as “frivolous” 9 out of 10 times.
DO NOT use their online dispute center – the credit bureaus don’t take those seriously because they think you can’t be too serious if you just click-click-clicked away to dispute it. Thinking about a short sale?

My Ventura County Short Sale Is Taking Too Long Because Lenders Can't Write Off Too Much Loss At Once...WHAT???

Your Ventura County Short Sale Specialist receives emails all the time that go something like this "The Bank’s Short Sale Problems are not that simple. A bank can't afford to write off too much loss at once. Also, their investors may not approve the short sale, because they can't afford to write off too much loss at once either. And the circle goes on."

Here is why this flawed assumption is incorrect. Most of the large, national banks do not own the mortgages they handle. As an example, Bank of America does not own 80% of the mortgages they service. The biggest holders are the GSEs: Fannie Mae, Freddie Mac, and Ginnie Mae.

These entities are accustomed to losses. The other entity that's set up well and accustomed to losses is FHA. Most of the remaining loans are owned by Wall Street Firms, Pension Funds, and other professional investors. Most of the loans owned by them have already been written down in value dramatically. In a few, isolated instances, the "We don't want to write off losses to fast because it will hurt this quarter's earnings" thing applies. But, it is also illegal because of accounting rules.

Not writing off losses that you know about could be considered insider trading by many. Besides, when you push the loss on non-performing loans off to the future, the losses are bigger in most cases. Any prudent person would agree that making losses bigger is bad business. The bigger problem is that the lenders don't have enough staff to process the files.

They need short sale negotiators to submit files to the owners of the loans. As an example, on a recent FHA short sale, the negotiator told us it would take her 2-3 weeks to review the offer and then submit it to the FHA. However, she did tell me that FHA only has a 72 hour turnaround from when she submits the file to them. That is pathetic.

Here is why the lender doesn't have any incentive to hire on more staff. On that file, the lender isn't losing the money, FHA is losing it. Therefore why should the lender spend money to hire on more staff? There is no incentive to do so.

Many homeowners have short sold their home and never missed a payment. The lenders will approve a short sale where the seller has not missed a payment when the following is in place.

1. The homeowner owes more on their home than it is worth.

2. The homeowner has a verifiable hardship that will force them to miss their payments in the near future. In these cases, the lenders know it is better to liquidate the home as quickly as possible.

Here Are Five Facts you Should Look Into When Considering A Ventura County Short Sale

  Short Sale if you are a financial superman. If you are a CPA or a Number Cruncher, then you understand that numbers are more important than warm and fuzzy thinking. Take a look at GM and all the businesses that “Short Sale.” You can call it that. They know the numbers are what matter to them. If you are too far upside down, then is better to walk away from the debt and start over.

  Do NOT Short Sale if you are going to make TONS of money in the future! You can probably convince your lender to grant you a loan modification and get back on your feet.

  Short Sale if you can find a rental home comparable to your home. You have to live somewhere. We have seen lots of homeowners find a nicer home to rent for a lower monthly payment than their “upside down” home. They Short Sold their house and were able to live a happier, more stress free life afterwards.

  Do NOT Short Sale if you think that you are different from large Wall Street Firms that willingly walk away from their obligations. Some people believe that people in debt deserve to work 80 hours a week for the rest of their life until they pay off their debt.

  This one drives me nuts. It is ok for Morgan Stanley to strategically walk away from their obligations on high rise buildings they bought as an investment, but it’s not ok for “Average Joe Homeowner” to walk away from his upside down house?

  What is wrong with the moral compass here? It is ok for a business to re-negotiate their debts with banks, but it is wrong for a homeowner to do it! Are you crazy? Why do banks write off millions in debt for businesses while the homeowners should pay forever and never get a real loan mod?

I guess they figure that homeowners not good business people and will allow the bank to push them around. As you can see, when you run the numbers Short Sales almost ALWAYS make financial sense. Staying in a home that is upside down makes lousy financial sense, unless you get an awesome loan mod. Now those are my opinions, and those points do not apply to every situation. What I am saying is that you really should look at your home as a financial investment, NOT a stone around your neck.

When you request your free loan modification guide, you will have the option of also receiving a property valuation. This is called a BPO (short for Broker’s Price Opinion), and it is a real estate agent’s opinion of the value of a property.

Lenders use BPOs to determine a property’s value for short sale processing. Find out what you can pay the lender as a monthly payment. Then, find out the mortgage amount that equals that payment. For example, $1,200 a month will pay off a $211,346 mortgage over 30 years. $2,000 will pay off a $352,243 mortgage. $3,500 will pay off a $616,426 mortgage. $600 will pay off a $105,673 mortgage.

The lender should approve your loan mod if the payment you propose will pay off a mortgage amount that is more than the property value. It is in their best interest because it will reduce their losses. In fact, lenders usually only net around 80-85% of a property’s value after foreclosure. This is why lenders were only willing to lend up to 85% of a property’s value historically.

So use this to your advantage. Keep reminding the loan modification negotiator of these facts. And hold the negotiator accountable if they reject your loan mod and lose even more money as a result.

I Need Ventura County Short Sale HELP!!: How Much Of My Debt will Be Forgiven When I Short Sale?

"I am upside down on my house. I owe over 700k and I have been told that it is now worth under 400k. I just hate to think how much it will cost me over the long term when you add in the interest I will repay.

I am wondering if my bank will forgive the entire debt in a short sale. What do you think? Kevin."

Here was our answer to Kevin's Question. Most of the short sales we are doing have results in the complete forgiveness of the upside down debt.

There are many different factors involved, such as the law in your state, the bank who has your debt, whether or not you have mortgage insurance, and a number of other factors.

But, in most cases the short sale results in the forgiveness of the debt. In other cases, we have negotiated a 100k debt down to a 13k promissory note.

It's not fun to repay that, but it's much better than repaying the entire debt. I can give you a better answer when I discuss your situation with you. Thinking about a short sale?
