Moorpark Short Sale Question-I Heard Home Values In Ventura County Went UP Over 40% Last Year, Is My Moorpark Short Sale Still SHORT?

The number of homes which closed / sold in January for the city of MOORPARK was 31, with an average price of $515,000. 

This represents an increase from last year of roughly 43.06%. This number is very deceiving because it DOES NOT solely represent home appreciation. 

A large portion of this gain has to do with the segment of the market which is selling now ie, larger homes selling this year vs last year.


The average home sale price in Ventura County has risen for 23 months in a row. Those gains have been double-digit, between 10.8 percent and 28.3 percent, over the past 19 months. 

Our February average was 24.2 percent below the peak $505,000 average home value with was attained in spring/summer 2007.

Step 5 To Fix Your Credit After A Ventura County Short Sale: How To Mail The Letter

The goal is to get your letter read, taken seriously, and responded to.

**Make sure you make a copy of whatever you are sending to the credit bureaus.** Just keep all your credit reports, letters, etc. in a file so you can use these later (this will be important.)

Send your letter, a copy of the credit report with the items you are disputing noted in Sharpie, and a copy of your driver’s license to each of the credit reporting companies.

This step CAN be a bit tricky, even though it should be the easiest step of all! Here’s why – the credit reporting firms don’t really like to deal with these dispute letters, and they change their mailing address for submitting these requests fairly often.

You will need to go to the website for Experian, Equifax, and Trans Union to get their dispute address. BUT DO NOT SUBMIT YOUR DISPUTES ONLINE, like their websites pushes you to do.

If you do this, your request is less likely to be taken seriously, and you won’t have any written record of what you submitted. Send each of your letters as Certified Mail. Your local post office will help you with this. Put the copy of the certification slip into your file as well. The certification slip ensures that you have a timeline started for restoring your credit.

Many homeowners have short sold their home and never missed a payment. The lenders will approve a short sale where the seller has not missed a payment when the following is in place.

1. The homeowner owes more on their home than it is worth.

2. The homeowner has a verifiable hardship that will force them to miss their payments in the near future. In these cases, the lenders know it is better to liquidate the home as quickly as possible.

A faster sale will reduce their losses on interest and property taxes. In addition, an owner occupied home usually sells for much more than a vacant home. Sure, the lenders don't like short sales. They hate losing money. (Don't kid yourself.)

But, they know that when a loss is inevitable, then it is best to do what they can to reduce the loss as much as possible. That is why they will approve short sales when the homeowner hasn't missed a payment yet. Here Are Five Facts you Should Look Into When Considering A Ventura County Short Sale

  Short Sale if you are a financial superman. If you are a CPA or a Number Cruncher, then you understand that numbers are more important than warm and fuzzy thinking. Take a look at GM and all the businesses that “Short Sale.” You can call it that. They know the numbers are what matter to them. If you are too far upside down, then is better to walk away from the debt and start over.

  Do NOT Short Sale if you are going to make TONS of money in the future! You can probably convince your lender to grant you a loan modification and get back on your feet.

  Short Sale if you can find a rental home comparable to your home. You have to live somewhere. We have seen lots of homeowners find a nicer home to rent for a lower monthly payment than their “upside down” home. They Short Sold their house and were able to live a happier, more stress free life afterwards.

  Do NOT Short Sale if you think that you are different from large Wall Street Firms that willingly walk away from their obligations. Some people believe that people in debt deserve to work 80 hours a week for the rest of their life until they pay off their debt.

  This one drives me nuts. It is ok for Morgan Stanley to strategically walk away from their obligations on high rise buildings they bought as an investment, but it’s not ok for “Average Joe Homeowner” to walk away from his upside down house?

  What is wrong with the moral compass here? It is ok for a business to re-negotiate their debts with banks, but it is wrong for a homeowner to do it! Are you crazy? Why do banks write off millions in debt for businesses while the homeowners should pay forever and never get a real loan mod?

I guess they figure that homeowners not good business people and will allow the bank to push them around. As you can see, when you run the numbers Short Sales almost ALWAYS make financial sense. Staying in a home that is upside down makes lousy financial sense, unless you get an awesome loan mod. Now those are my opinions, and those points do not apply to every situation. What I am saying is that you really should look at your home as a financial investment, NOT a stone around your neck.

Your Lender Will Not Collect Any More Money From You After A Ventura County Short Sale

Ventura County CA – Many homeowners considering a short sale are concerned about a deficiency. "Will I be forced to repay my bank for the $150,000 they lost", they ask me.

The good news is that most homeowners are able to walk away from their home without paying their lender another dime. A big part of this is because their lender agrees to that as part of the terms of the short sale.

In addition, many states, such as California, require lenders to erase any deficiency when a homeowner short sells their home.

But, these are for cases when the homeowner is short selling their house and the lender has included language in the short sale paperwork specifically releasing the borrower from a deficiency.
What about situations where this isn't happening. As an example, many states allows lenders to collect a deficiency after a foreclosure. even when a lender.

With a judicial foreclosure the lender already has a judgment they can use to garnish wages and levy bank accounts. So does that happen? We haven't seen any cases of it happening.

We think the reason is because most homeowners simply declare bankruptcy when they are faced with sudden $100,000 bill. The lenders see this happen a few times and decide it isn't worth the effort.

Taking a look thru court cases at the local courthouse hasn't turned up any lenders collecting on a deficiency. Remember, there are thousands more foreclosures than deficiency judgments.

The lenders probably view collection on a deficiency as difficult and unlikely to bring much return on the investment. That is why we think they don't even both with it.

Ventura County Short Sales, How We Negotiate with the Banks Negotiator…and Win.

A bank should approve a short sale if doing so will net the owner of the loan more money than a foreclosure.

 Remember all banks and servicers have a fiduciary duty to the entity that owns the loan. If they own the loan themselves, they have a fiduciary duty to their stockholders.

Their fiduciary duty is to reduce that losses on the loan as much as possible. So, a lender should accept an offer if it will net the most money.

 The Realtors only job is to prove that the short sale offer will net them the most money. We do that by showing them that the property has been on the open market for 60-90 days.

The Realtor needs to be able to show that the house was easy for buyers to see and other agents to show.

 We tell them the following, "I'm an Certified Short Sale Specialist, a Certified Distressed Property Expert, a Certified HAFA Specialist and have a full time short sale department experienced and dedicated to getting short sale transactions approved and closed. We have had this house listed for X days. The seller has lived there the entire time and kept up on the house. It looks good.

We have had 43 showings since then. Out of that, only 3 buyers expressed interest. Out of those 3 buyers, the current buyer is the one willing to pay the most money. I'm doing my job marketing the property.

 With the current foreclosure case status, the home won't be foreclosed for another 6 to 18 months. When you (the bank) foreclose on the house, the owners will move out.  If you (the bank) do foreclose, the REO (Banks) listing agent will be working on 20 other homes and won't be able to do as good of a job marketing the home as I am doing. Plus, the home will sit abandoned for an additional 6 months before you (the Bank) are able to work it into your inventory of homes ready for sale.

Around here Spring is the best time of the entire year to sell a home.
It will be winter when you first put the home on the market. That is the slowest selling season of the year. Do you (the Bank) honestly think the home is going to sell for more money at that time?"

Congress needs to act, or forgiven Ventura County Short Sale Mortgage Debt won’t be forgiven next year.

At the same time that a bright spot has emerged for struggling home owners trying to get a short sale closed — Fannie Mae and Freddie Mac now require shorter short sales from lenders they work with — there’s a looming cloud.

Let’s say you owe $150,000 on your mortgage, but your REALTOR® finds a buyer willing to pay $120,000. The bank approves the short sale and forgives the $30,000 difference. If you don’t complete the sale by Dec. 31, 2012, as of Jan. 1, 2013, that $30,000 in forgiven mortgage debt will be considered taxable income by the IRS.

It hardly seems fair, given that that the reason the lender forgave the debt in the first place was to facilitate the short sale — and help an underwater home owner climb out of financial hardship. Now, those home owners will be responsible for paying a new tax on “phantom” income. And it’s not just debt forgiven in a short sale that would be affected: The same tax hike would apply to home owners who work with their lenders to restructure their mortgages if they’re granted debt relief.

 Back in 2007, Congress passed a law designed to protect home owners from the tax, but that protection expires at the end of 2012. However, one Senate bill recently introduced by Sen. Debbie Stabenow (D-Mich.), — and two House bills — recently introduced by Reps. Charles Rangel (D-N.Y.) and Tom Reed (R-N.Y.) — seek to extend the law and eliminate the new tax. The Stabenow and Rangel bills would extend the expiring law for two years, and the Reed bill would extend it for one year.

“Mortgage debt forgiveness is not disposable cash for the mortgage holder,” Reed said in a statement. “Piling additional burdens on people at such a difficult time makes their precarious situation worse.” Thinking about a short sale?

“It’s bad enough that so many families are faced with mortgages that now exceed the value of their home,” Stabenow said in a statement. “But to add insult to injury, without this bill, the IRS would once again require these families to pay hundreds or thousands of dollars in additional income tax when they sell or refinance their home. That’s just wrong.”

There’s time yet for Congress to pass one of these bills — or better yet, make debt foregiveness relief permanent — but with so much uncertainty in the housing market, legislative action can’t come soon enough.

Why Are Some Ventura County Foreclosures and Short Sales Being Sold With Tenants Still In The Property?

Ventura County CA – A person recently asked me about how the banks foreclose on properties with a tenant living in it.
"Why would a bank go to the trouble of a foreclosure if there is already a tenant in the house paying them?", they asked me. That's an interesting question.

I think that the reason this happens is because the banks are not in the real estate business. They don't want to deal with collecting rents, handling evictions, and all the other work associated with rental properties.

They just don't have the infrastructure in place to deal with that. I think the other reason is because there are federal banking laws that prohibit banks from owning investment property.

If the banks were allowed to own rental property, then they would be more inclined to foreclose on homes. Because of this the banks don't want to own a home with a tenant.

They want to foreclose on the house, sell it, get their money back, and lend that money to someone else. That is why the foreclose on tenant occupied homes. Thinking about a short sale?

Ventura County Short Sales: Why Do Bank Negotiators Break The Rules?

Ventura County CA – We had a negotiator at Bank of America try to push us around a little while ago. We’ve studied and analyzed all of the short sale guidelines and rules.
This was an FHA loan and therefore would be governed by FHA’s Short Sale Guidelines. This means that the lender must follow FHA’s Specific Instructions on how to handle the short sale. Here's what happened.

FHA sends all of the lenders who handle their loans a letter called "Mortgagee Letter 2008-43." It details exactly how the banks servicing an FHA loan are supposed to negotiate on a short sale.

This letter is 16 pages long and gives them specific directions on how much to pay agents, what percentage of the appraisal they can accept, etc.

We had had a wretched experience another FHA short sale. The lender lied to the seller's prior agent and hadn't followed the FHA Short Sale Guidelines. Because of that experience, we had read thru this letter 2-3 times.

Bottom line, we know a little bit about FHA's rules for short sales. The problem was this negotiator at a large national bank didn't want to follow the rules!

Instead she made up her own rules! She told us that the buyer and seller had to split the cost of the title insurance. The problem is on page 12 of the Mortgage Letter, it says that they are allowed to approve a file paying the standard title insurance costs.

In our area, it is the sale's contracts are written with the seller paying for the title insurance. The buyer pays their closing costs and the title insurance for their lender.

But, this negotiator didn't want to allow that. I had to argue back and forth with her for 2-3 days until she finally relented. FHA is insuring this lender against any and all loss on the loan.

They have given that lender an almost risk free way to make a decent profit on a mortgage. If they have given you specific instructions on how to negotiate a short sale, then follow those instructions!
Here is the bottom line. If the negotiator at the lender is lying to you, then ask for their manager. When you talk to their manager, explain how they are breaking the rules.

Tell them you may contact FHA and tell them that the lender is breaking the rules. Thinking about a short sale?

Ventura County Short Sales: How We Overcame The Odds To Make This Short Sale A Success

Ventura County CA – Here is a success story on a short sale that the Stop Foreclosure Institute worked on for a long time. This was a very difficult short sale and it dragged out for over a year.

The reason that this short sale drug out for such a long time is because the short sale lender thought that the house was worth more than its actual value.

Imagine that you were a bank losing hundreds of thousands of dollars on a loan. You hire an appraiser and he says the house is worth 380k. Would you accept a short sale offer for 275k? No!

We had the home on the market for six months and 275k was the highest price any buyer was willing to pay. Here is why there was such a big discrepancy between what a buyer was willing to pay and what an appraiser thought the house was worth.

The house was located in the country about 12 miles outside of town. Most people will pay more for a house that is located closer to town. Three miles to the East of this house was an upscale area of luxury homes.

Most of these homes were located in well maintained, gated communities. The person who appraised this home used those homes as comparable sales for the appraisal.

But, it gets worse. This home had no garage and was located down about a mile of dirt road and surrounded by lower priced homes. The comparable sales the appraiser used were an apples to oranges comparison.

That was why the home was not selling for what the bank thought it was worth. We submitted two different short sale packages over the course of 9 months.

Both times the bank told us they wouldn't approve the short sale because they thought the home was selling for less than it was worth.

We finally lucked out on the third short sale offer. This time the home appraised at an accurate value and the bank approved the short sale. However, the home had declined in value over the past year.
