Ventura County-Thousand Oaks Short Sale: If You Bought At The Market’s Peak, Does It Make Sense To Short Sale Your Home?

By Chris B Johnson Realtor, Ventura County-Moorpark CA –

Many homeowners bought their home at the peak of the market. In the hardest hit areas, they paid $500,000 for homes that are not selling for $250,000 (or even less.)

Their home is costing them $4,000 a month. (That is the total after paying property taxes and insurance.) Renters have moved into the neighborhood and are paying less than $2,000 to rent a comparable home.
It just seems like these homeowners are getting an unfair deal all around. Should these homeowners dump their homes in favor of a lower priced home?

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Some people say No! “That is breaking your word. If everyone did it, just think of what would happen?” they say. There is a little problem with that logic.

Many of those homeowners see everyone else taking advantage of the system. It has gotten so bad that in some neighborhoods most of the homes have been abandoned.

Why shouldn’t a homeowner do what is best for themselves? After all, they can save hundreds of thousands of dollars.

Let’s say they short sale their home with a $500,000 mortgage, rent for 2-3 years, and then buy later. But, what if home prices appreciate over the next few years?

If they are already upside down by 50%, then it still makes financial sense to short sale now. If the housing market has improved by 5% a year, their $250,000 house will have increased to $289,400 in three years.
That is still much less than $500,000. In addition, they will save even more on interest payments. I am not recommending they do anything.

I just want to lay out the benefits and leave the decision up to them. Thinking about a short sale?

Ventura County Short Sales: My home is in foreclosure. How soon will the bank kick me out?

Your BEST CHOICE FOR A REALTOR IN VENTURA COUNTY CA, Ventura County Certified Short Sale Specialist, Ventura County Short Sale Help, Certified Short Sale Negotiator, Stop Foreclosure Institute of Ventura County, Your Top Listing Realtor with Prudential California Realty, Moorpark, Ventura County, Moorpark CA –

The Stop Foreclosure Institute recently received a question from another realtor named Sandy. Here is her question. “An agent in my office currently has a listing under contract. It is a short sale, the sad thing is that Large National Bank (to remain unnamed) notified the sellers that they had foreclosed a month ago.

Fact is, they had not foreclosed. The employee didn’t know what they were talking about. Valuable time and a buyer were lost during this fiasco. This deal is currently awaiting approval.

There is no telling what will happen in the end. My question is this. What can we do to track the foreclosures and see when the bank is foreclosing. Sandy."

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Here is the answer to Sandy’s Question. The best way that I have seen to track this is by checking the docket. The docket is the record at the courthouse of everything that is happening on a foreclosure.

In some states the foreclosure is a court case and you can track the case. The bottom line is that your local courthouse will have the best information. Call them and ask for them to explain it to you.

You will need the homeowner’s name and sometimes the court case number. They will explain where the foreclosure is at and how much longer it will be before it is completed.

Step 2 To Fix Your Credit After A Ventura County Short Sale: Analyze Your Credit Report

Certified as a California Association of Realtors HAFA Specialist, a National Association of Realtors Short Sale and Foreclosure Resource, Chris B Johnson Realtor is a Certified Distressed Property Expert, Certified Short Sale Negotiator and Certified Pre-Foreclosure Specialist. Ventura County CA – Once you have gotten your credit report, the next step in the process of restoring your credit score is to go over it with a critical eye. Analyze what the report says.

Put aside any emotion that looking at the report might stir up – you need to look at it objectively.
First, make two copies of your credit report. Save the original without any marks on it. You can make any notes you need on one of the copies, and put the other copy aside for a later step.

Your credit report will show all sorts of history on your credit accounts. Look for all the negative items on your credit report and highlight each one.

The credit reporting firms might not make it easy for you to know what they are considering negative with all the codes they use.

As a very general rule, Experian notes negative items with an asterisk or an inquiry; Equifax and TransUnion put “>>>” as a way to signal negative items or items that have a rating higher than l1, M1, or R1.

You can also look for these words: repossession, foreclosure, profit and loss write-off, charge-off, paid profit and loss write-off, paid charge off, settled, settled for less than full balance, included in bankruptcy, collection amounts.

Paid, unpaid (or anything indicating payment history); court accounts, liens, judgments, bankruptcy (chapters 11,7, or 13) divorce, satisfied liens, or satisfied judgments; or items that show more than 30, 60, or 90 day payments. All of these should get highlighted by you.

Once you’ve highlighted anything that is listed as negative, take out a pencil and put a note next to the items that are either inaccurate or inconsistent. Inaccurate items are the ones that aren’t yours, or show the wrong balance, etc.

An inconsistent reporting is where the same information on the report contradicts itself somewhere else. For example, showing one place that there are twelve 31-day-lates on an account, while also saying that the account was only reviewed for 4 months.

It is always surprising how often there are errors like that found on credit reports. Remember – there’s a whole lot of information being submitted each day to these companies, and mistakes can happen.

The next step will be important to take as soon as you finish highlighting your report.

You will need to move quickly through these first few steps – your timing is all tracked and it’s important for you to be diligent so that your credit can be restored.

Are Fannie Mae Short Sales Tough? Ventura County Short Sale Question:

Your BEST CHOICE FOR A REALTOR IN VENTURA COUNTY CA, Ventura County Certified Short Sale Specialist, Ventura County Short Sale Help, Certified Short Sale Negotiator, Stop Foreclosure Institute of Ventura County, Your Top Listing Realtor with Prudential California Realty, MoorparkVentura County Short Sales –

Another agent recently e-mailed the Stop Foreclosure Insitute. They were having a hard time with a short sale on a Fannie Mae Loan.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Here is an excerpt from the agent's e-mail. "I spoke with Josh @ Fannie Mae. He said that once there is a foreclosure sale, per an agreement with the lender, Fannie Mae would pay the lender the full balance of the note. I started to comment that what incentive is there for the lender to process a short sale. He said I know where you’re going with that and we couldn't comment.

It appears that the title would be transferred to Fannie Mae and the lender would be reimbursed for the FULL balance of the note. This is crazy! When Fannie Mae is the investor, it seems a JOKE to bother with the short sale!!

My Comments: Fannie Mae short sales are the best and easiest short sales to get approved. This is because Fannie is one of the most reasonable loan owners out there. The problem is that no one at the lenders really cares. The reason the lender is getting paid off completely is because they already sold the loan to Fannie.

Remember, Fannie was created to free up lender's money. That way lenders could go make more loans. The problem is that Fannie has entrusted their investment to these lenders. Let me explain.

Here is how I see it. It's a huge win for a lender to under staff the departments handling their loan. Their business model is to grant loans and sell them to Fannie for a profit. Fannie takes on all the risk and even pays you a monthly payment for collecting the payments Cut your staff handling their loans to the bone. That way you can make a monthly profit from the monthly Fannie payments. A lender can't lose. You make money granting the loan. You sell the loan to Fannie for a profit. You make money each month handling the loan for Fannie. At the end of the day, the loan goes bad. You can't do a competent job negotiating the short sale.

Why is that? The reason is you are cutting staff costs. But, you don't lose money from your negligence. Fannie Mae and Uncle Sam do. Sound like a sweet deal?

But, we still love Fannie Mae Short Sales. The Stop Foreclosure Institute has sold countless Fannie Mae Short Sales successfully.

Ventura County Short Sales: Why A Second Mortgage Is Willing To Negotiate On A Short Sale

Your Ventura County Certified Short Sale Specialist. Loan Modification Denied? HARP re-fi denied? Want to avoid foreclosure? THE BEST REALTOR IN VENTURA COUNTY CA,Ventura County Short Sale HELP!! –Are you wondering why a Second Mortgage or HELOC gets zero from a foreclosure. Let me explain why.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.  When a property is foreclosed upon, it is auctioned on the courthouse steps.  Let me give you a scenario where a homeowner owes the following on the property.  First Mortgage is owed $200,000.  Second Mortgage is owed $40,000.  There is a HELOC (Home Equity Line of Credit) that is owed $100,000. (The home increased in value to $400,000 and a lender agreed to grant the loan.)  So a total of $340,000 is owed on the property. Now, what if it only sells for $150,000 on the courthouse steps. Who gets that $150,000?  The first mortgage does. The second mortgage wouldn’t get a dime unless the property sold on the courthouse steps for more than $200,000.  The HELOC is in third position and doesn't receive any money unless it sold for more than $240,000. This is why a second mortgage gets so little money from a foreclosure.  Historically, second mortgages were loaned for the top 20% of the property value. The lower 80% was the first mortgage.  In most cases, the attorney fees, foreclosure costs, delinquent property taxes, and other fees would bring the first mortgage’s total up to around 100% of the property value.  This is why in most cases a second mortgage rarely gets any money from a foreclosure. Of course there are other variables that can change things, but this is how it usually works. Thinking about a short sale?  I can help you short sale your property and get back on your feet. Send me an e-mail at cjohnson@prucalhomes.com. I will contact you for a free consultation.  When we talk, I will explain how the process works in detail and answer any questions you may have. Why Isn't Anyone Holding These People (The Bank's Valuation Departmants) Accountable On Ventura County Short Sales?

Ventura County CA – Are you thinking about short selling your home? Here is a way that any seller can help with the short sale. First off, the biggest problem is that there is very little accountability in the short sale industry.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
The banks use appraisers and other people to tell them what a house is worth before they sell it. They banks will not approve a short sale offer unless the house is selling for close to what these people tell them it is worth.

The bank's use this process to make sure that they are not selling homes for less than they could sell them for after a foreclosure. Here is why there is very little accountability.
Very few people ever look at the valuations turned into the bank. The realtor helping you with your short sale can't access this information. The valuations often have glaring inaccuracies in them.
For example one property was valued at 375k. Because of that valuation a short sale offer for 275k was turned down. We can agree that it would be stupid for a lender to accept 275k for a house worth 375k.

However, the house wasn't worth 375k. It had been on the open market for several months and that was the highest offer received from any home buyer. But, it gets worse.
The home ended up selling as a short sale for $235,000. Yes, that bank lost $40,000. But, why did it happen? Because someone gave the bank an inaccurate property value.
However, that person was never held accountable for their actions. They caused a bank to lose $40,000. But today they are still doing property valuations for banks. It's insane, isn't it?
In tomorrow's post we'll detail what you, the short sale seller, can do to help with this problem. Thinking about a short sale?

I can help you short sale your property and get back on your feet. Send me an e-mail at cjohnson@prucalhomes.com. I will contact you for a free consultation.

When we talk, I will explain how the process works in detail and answer any questions you may have. Or, if you prefer, you can call me at 805-208-0823.

How Does the Realtor Get Paid On A Ventura County Short Sale ?

Ventura County CA – A potential home seller asked The Stop Foreclosure Institute how we get paid on a short sale transaction. So I decided to answer that question in today’s blog post.

Here is how most Realtors get paid on a short sale. They make a real estate commission from the sale of the property. When the property sells a percentage of the sales price is paid as a commission.

Discover how other sellers successfully did a short sale to avoid foreclosure by clicking here.

Man sellers mistakenly think that since there is no equity in the property, then there is no way for the agent to be paid. In this situation the seller’s lender pays the commission.

They are willing to pay a commission on a short sale because if the property is foreclosed upon, not only will the property sell for less money, but they will also have to pay a commission on the sale of the foreclosed property.

Here is an example. You owed $500,000 on your home. The home is now worth $400,000. After real estate commissions, attorney fees, property taxes, sales taxes, and other miscellaneous fees, your lender will net $370,000.

Most people would be horrified at losing $130,000. However, lenders know there is risk in their business. They grant loans knowing that a certain percentage of them go bad.

After they have realized that a loan has gone bad, all they want to do is reduce their losses as much as possible. So they will sit down and calculate the losses on their different options.

We all know the short sale will net them $370,000.

How much will a foreclosure net them? Let’s run the numbers. If the house is worth $400,000, then it will probably sell for 10% less after a 12 month foreclosure process.

So they have a sales price of $360,000. Now, they have to add in real estate commissions, attorney fees, sales taxes, and all the other costs. They could end up netting around $310,000 after the foreclosure.

Accepting the $370,000 on the short sale and paying the realtor is a good alternative. Therefore they are glad to accept it and pay us to sell the property.

A Common Myth About Ventura County Short Sales: Banks don't like short sales and prefer foreclosure

Ventura County CA – One of the Stop Foreclosure Institute members talked to a homeowner recently about a short sales. Her house was close to being foreclosed upon.

She had thought about short selling the house. But, she had heard from her friends that banks don't really like short sales and never pursued the option.

Discover how other sellers successfully did a short sale to avoid foreclosure by clicking here.

The fact is that banks are better setup for foreclosures. It is only with the recent historic drop in home values that short sales have more common.

Banks always knew that a short sale would reduce their losses compared to a foreclosure. Even the federal government agrees. That is why congress added short sale incentives to the recent loan modification laws.

FHA is another quasi federal agency that prefers short sales over foreclosure. They pay lenders $750 to process a short sale. I don't think they pay them anything extra to process a foreclosure.

The bottom line is that most lenders do prefer short sales over foreclosure. The reason is best explained by a recent study done by Boston Consulting Group.

The study found that a short sale nets a lender 20% more than a foreclosure. Banks understand numbers and want to reduce their losses. Thinking about a short sale?

Ventura County Short Sales: The Wait To Buy Another Home After A Short Sale Was Recently Changed to 3 Years

Ventura County CA – The Stop Foreclosure Institute recently received a question from Christina. Here is her question.

Discover how other sellers successfully did a short sale to avoid foreclosure by clicking here.

"I just read your article Frequently Asked Questions about Short Sales. You mention that you can obtain another home loan two years after a short sale.

Who are these lenders and how can I contact them? I have been looking but so far no luck. Everyone is insisting we must wait three years. I'd appreciate any information you can provide. Christina."

We just heard back from our mortgage broker on this issue. Fannie Mae recently changed their guidelines for a loan after a short sale.

(Since most lenders and loan programs follow Fannie Mae's Guidelines, that means that almost every single lender changed their policies as well.)

When we wrote the article their guidelines had said that you had to wait two years after a short sale. Now those guidelines have been changed to 3 years.

The good news is that you can still buy a house after a short sale. Life does go on and will go back to normal. No matter how bad things may seem, they will get better.

Before you know it the 3 years will pass and you can buy another home. The housing market is still flat and will probably be flat over the next 3 years.

So you will be able to buy the next house for substantially less than what you paid for your current home. Thinking about a short sale?

Ventura County Short Sales: How To Negotiate Away Promissory Notes

Ventura County CA – If your loan has Private Mortgage Insurance, also known as PMI, then there is a high likelihood that they will request that you sign a promissory note.

Today’s blog post talks about how to convince the lender to waive it.

Discover how other sellers successfully did a short sale to avoid foreclosure by clicking here.

PMI companies are notorious for asking for promissory notes. The reason they ask for them so much is because there is no risk in doing so.

If the home is foreclosed upon, then they will have to pay a claim for the loss. If the home is sold as a short sale, then they will have to pay a claim for the loss. Either way, they have the same result.

But, if they get a promissory note, then they get some money to help cover the claim. Either way, there is no risk to them.

All that you have to do to avoid the PMI promissory note is show the PMI negotiator that the seller has no assets and does not have the ability to pay a promissory note.

You want to speak directly with the PMI negotiator. If you must, then escalate the file to a supervisor.

When they see the seller has no assets, they will still push for a promissory note. You have to hold firm and sometimes even threaten to go to the press.

If you have made a good case and talked to the right people, then they will usually waive the promissory note. Thinking about a short sale?
