Ventura County Short Sales: Can I Short Sale If I Have Substantial Assets & Good Income?

Here is Dave's Question. "I bought several investment properties at the peak of the market. The homes have dropped in value by almost 40% and I am losing money on the rent every month. I am sick of writing a check every single month to cover the loss.

I would like to short sale these properties if possible. I am just wondering if the banks would allow it. What do you think?”

Here was our answer. Dave, there is no answer that is correct 100% of the time. In your situation, it depends on your lender. Many lenders will allow a short sale. Others won’t talk to you until you are behind on the payments. I do know a friend of a friend who is in a situation very similar to yours and is short selling several properties.

He has substantial assets and a good income. Some of the banks were easy to work with. He was able to stay current on the payments until they approved the short sale. However, some of the other banks weren’t as easy to work with. He had to stop making payments before they would talk to him.

It all depends on the bank and how much you want to short sale. I know several people that write big checks every month just trying to stay afloat on their rental properties. If you aren’t planning on buying another house for 2-3 years, and want to stop the bleeding, then a short sale is a great option. If I were you, then I would attempt a short sale. It doesn’t cost you any money. I don’t see how you can lose.

Ventura County Loan Mod Help: How To Reduce Your Payments Without A Loan Modification



Ventura County CA – Getting a loan modification accepted is tough. Many that should have be accepted end up rejected. I recently saw a bank foreclose on a 400k mortgage.

The house sold for 130k! They would have made more money just cutting the homeowner's payments in half! This kind of stupidity gets on my nerves.

Some people have mentioned a strategy that can help you reduce your payments without a mod. A person with two mortgages just stops paying the 2nd mortgage. I won't recommend that you try it.

Here is why some people have said this strategy works. Let's say John owns a house worth 200k. He owes his 1st mortgage 200k, and his 2nd mortgage 50k. John stops paying the 2nd mortgage.

The 2nd mortgage has few options. They can call and threaten to foreclose. A phone call is free and most people get scared and pay up. They run the numbers on foreclosure and decide it is a losing proposition.

The house will sell for 200k and every dime of the 200k goes to the 1st mortgage. The 2nd gets zero. Besides, it costs money to hire a lawyer and pay all the other foreclosure costs. This is why 2nd mortgages rarely foreclose.

You could say that they are almost an unsecured debt, almost like a credit card. I’ve even heard that you can “strip away” an upside down 2nd mortgage in bankruptcy.

The bankruptcy judge must determine that your house is worth less than what you owe your 1st mortgage. They will determine that the 2nd mortgage is “unsecured” and wipe out the debt and mortgage thru bankruptcy.

Rather than going thru bankruptcy you can just stop paying the 2nd mortgage and see what happens. In many cases the only collections they will do is to call you and mail you letters.

Ventura County Short Sales: The Wait To Buy Another Home After A Short Sale Was Recently Changed to 3 Years


Ventura County CA – The Stop Foreclosure Institute recently received a question from Christina. Here is her question.

"I just read your article Frequently Asked Questions about Short Sales. You mention that you can obtain another home loan two years after a short sale.

Who are these lenders and how can I contact them? I have been looking but so far no luck. Everyone is insisting we must wait three years. I'd appreciate any information you can provide. Christina."

We just heard back from our mortgage broker on this issue. Fannie Mae recently changed their guidelines for a loan after a short sale.

(Since most lenders and loan programs follow Fannie Mae's Guidelines, that means that almost every single lender changed their policies as well.)

When we wrote the article their guidelines had said that you had to wait two years after a short sale. Now those guidelines have been changed to 3 years.

The good news is that you can still buy a house after a short sale. Life does go on and will go back to normal. No matter how bad things may seem, they will get better.

Before you know it the 3 years will pass and you can buy another home. The housing market is still flat and will probably be flat over the next 3 years.

So you will be able to buy the next house for substantially less than what you paid for your current home. Thinking about a short sale?

Another strategy to use when negotiating a Ventura County Loan Modification

Ventura County CA – Lenders hate losing money. They hate loan modifications, principal reductions, and any other thing that causes them to lose money.

But, in today's tough economy they have no choice but to accept them. The primary reason a lender will grant a loan modification is because that usually reduces their losses.

If they foreclosed on the house instead, then the losses would be larger. Besides most foreclosures take 18-24 months and often longer.

(That alone should convince you that their losses will be larger after a foreclosure.)

Use this to your benefit when negotiating a loan modification. Hire a real estate agent to tell you what your house is worth. Then, show your lender that value.

Now, add in all the costs that you can think they will incur if they foreclose on your home. Below are some examples costs.

Current Market Value: $300,000.

Lost Interest income at 5% over two years. $30,000.

Property Taxes over two years: $6,000.

Home Insurance costs for two years: $3,000.

Projected Net from a foreclosure: $261,000.

Because the lender can clearly see how much money they will use, it make it much easier to negotiate a reasonable loan modification.
