Short Sale Fraud?? Did Governor Jerry Brown Take Your Short Sale, Principal Reduction and Loan Modification Money?

Short Sale HELP, Short Sale Specialist, Moorpark Short Sale Specialist, Simi Valley Short Sale Specialist, Thousand Oaks Short Sale Specialist, Westlake Village Short Sale Specialist, Newbury Park Short Sale Specialist, Camarillo Short Sale Specialist, Ventura County Short Sale Specialist,By Chris B Johnson Realtor, Ventura County CA- Organizations representing blacks, Latinos and Asian Americans sued California Gov. Jerry Brown on Friday, alleging that the Democratic governor unlawfully diverted hundreds of millions of dollars to the state's general fund that should have been used to aid victims of the foreclosure, short sale and principal reduction crisis according to the National Mortgage Settlement. From   Monday, March 17, 2014
Mortgage Servicing
The suit involves a $369 million pot of cash the state of California received as part of the settlement in 2012 between 49 states and the country's five largest mortgage servicers.

At the time, California was facing a state budget shortfall. Brown diverted most of the $369 million away from a housing-related fund in order to help plug the budget gap, according to the lawsuit.

The lawsuit's plaintiffs are the National Asian American Coalition, the National Hispanic Christian Leadership Conference, and Cor Community Development Corp., a group that's affiliated with thousands of black churches.

They allege that Brown's decision violated state law. Their suit also charges that the governor's budget maneuver impinged on the state attorney general's authority to settle lawsuits on behalf of the state.

The plaintiffs are asking that the money be returned to its original fund, in order to be used for mortgage counseling and other housing-related purposes such as Short Sale Assistance, Loan Modification Assistance, Principal Reduction and Deficiency Waivers.

Since 2012, California's fiscal outlook has improved considerably, and the state currently has a budget surplus.
"The governor had no legal right to divert these funds in the first place and, even if he did, he certainly has the statutory duty to replenish them in this year of surplus," the lawsuit states.

The governor's office referred comment on the lawsuit to the California Department of Finance. A spokesman for that agency said in an email: "While we haven't yet seen the complaint, we're confident that our budget actions are legally sound."

A spokesman for Attorney General Kamala Harris declined to comment on the suit.

Initially, Harris, a Democrat who negotiated a hefty share of the national mortgage settlement for California, spoke out against the governor's decision to divert the funds.

"While the state is undeniably facing a difficult budget gap," the attorney general said in a May 2012 Facebook post, "these funds should be used to help Californians stay in their homes."

But Harris has not argued publicly that the governor's decision was unlawful.

The lawsuit was spearheaded by longtime public interest lawyer Robert Gnaidza and Neil Barofsky, the former special inspector general for the Troubled Asset Relief Program who has loudly criticized the Obama administration for failing to provide more assistance to victims of the foreclosure crisis.

During a conference call with reporters, Gnaidza acknowledged that Harris finds herself in a difficult position.
"She did a better job than any other AG in the country in getting a good settlement," he said. "But I think she also feels a loyalty as attorney general to the governor."

Faith Bautista, president of the National Asian American Coalition, said she's focused on getting assistance for the two million households that still face the prospect of losing their homes. "Homeowners need help," she said.
Other states besides California have also used money they received from the mortgage settlement for purposes unrelated to housing.

When asked if he's considering suing other states, Gnaidza said: "There are at least 15 states, such as Georgia and Nevada, where this could be done. I suspect there will be other suits within a few months."

Qualifying Short Sale Buyers-What You Should Look For In A Buyer Of Your Ventura County Short Sale Property?

Short Sales in Moorpark, Certified Home Affordable Foreclosure Alternative Specialist, Certified Short Sale Negotiator, Certified Short Sale Specialist, Moorpark Short Sale Specialist Chris B Johnson Realtor,
Buyers Need To Put Down A Cash Deposit To Show They Are Serious

By Chris B Johnson Realtor, Ventura County, Moorpark CA

 – Short Sales can be tough. Many buyers don’t understand the process and think that since it is a buyer’s market, then they set the rules. That’s not the case.

You, the seller set the rules. After all, you still own the property. But, more importantly, you must set the rules for offers. If you don’t then you dramatically reduce your odds of successfully short selling your property.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Here is what you should think about before you take your home off of the market.

1. You should only accept and work with one offer at a time. If you accept more than one offer at a time, then buyers get mad.

The primary offer might get angry because you accepted a backup offer. In addition, multiple offers confuse everyone involved including the short sale lender.

2. You should make sure the buyer can get financed for a loan. That means the buyer should give you genuine proof of that, whether a pre-approval or pre-qualification.

3. We recommend that the buyer inspect the home before the sales contract is signed. If any unexpected problems come up (and they do), then you can adjust the offer price that is submitted to the short sale lender.

This saves from having to negotiate the price again if a problem is found after the short sale is approved. Besides, the lender is more likely to accept a lower price if you send them a copy of the inspection.

4. The buyer agrees to wait the necessary 60-90 days for an answer on the short sale. That time will depend on the lender. Some lenders are fast and some are slow.

5. The buyer should put a reasonable deposit in escrow to keep them on board for the necessary time required for the short sale to be approved.

These are what we have determined to be necessary for a successful short sale. If you don’t have a serious buyer then you are wasting your time and your agent’s time as well.

Many buyers and their agents think that since a property is a short sale, then offers can be treated very casually. This only hurts the home sellers trying to avoid foreclosure when the buyers can’t get a loan or back out after the inspection.

Helping someone avoid foreclosure is serious business. That’s why we treat it as such. Thinking about a short sale?

Our services have not been reviewed or endorse by the government or your lender. Most lenders willingly work with agents on short sales. Why?
Because most short sales are beneficial to a lender. If you accept our offer to help you on a short sale, your lender may not agree to a short sale or to modify your loan. We do offer a loan modification kit.
However, the likelihood of negotiating a modification is like everything else in life. It takes work and persistence to convince your lender to modify your loan. No matter what you or we do, your lender may not approve a loan modification.
We do not recommend that you stop paying your mortgage, because this will cause damage to your credit and could cause you to lose your home. Because we know avoiding foreclosure is so important to any homeowner, we recommend that you speak with the appropriate legal or tax advisor before making any decision.

Yes, Banks Are Approving Short Sales in Ventura County

Ventura County CA –

The Stop Foreclosure Institute sometimes receives e-mails from people that short sales are impossible.

Well, short sales are not impossible. They just take time. Here is an example. The Stop Foreclosure Institute was attempting a short sale on a property. The bank turned down an offer for $220,000 on the house.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Today it looks like an offer for 185k will be approved. Why is that? The first offer was submitted 4 months ago. The bank did an appraisal. The appraiser thought the house was worth $265,000.

The lender rejected the offer because it didn't meet their guidelines. We put the home back on the market and waited for another offer. The property values continued to decline.

The next offer came in for $185,000 several months later. The bank re-opened the short sale process and ordered a new appraisal. This appraiser thought the house was worth $197,000. The bank approved the short sale offer.

As you can see, short sales can get approved with a little luck, time, and persistence. With some luck, the bank will see that the short sale makes financial sense and approve it. We've seen over 50% of our short sales sell, get approved, and close in 3-4 months. And that's the first attempt at negotiations.

The majority of the remainder will get approved, but we will have to submit more offers. Thinking about a short sale? I can help you short sale your property and get back on your feet. Send me an e-mail at cjohnson@prucalhomes.com.

I will contact you for a free consultation. When we talk, I will explain how the process works in detail and answer any questions you may have.

Step 9 To Fix Your Credit After A Ventura County Short Sale: Rinse & Repeat

Your BEST CHOICE FOR A REALTOR IN VENTURA COUNTY CA, Ventura County Certified Short Sale Specialist, Ventura County Short Sale Help, Certified Short Sale Negotiator, Stop Foreclosure Institute of Ventura County, Your Top Listing Realtor with Prudential California Realty, Moorpark, http://bit.ly/14WW3B0Ventura County CA – The next step in your path to an improved credit score is to do what they say on the shampoo bottles: Rinse and Repeat.

In the Rinse and Repeat phase, you just keep working their system.

Here’s what I mean: You send in a dispute, maybe disputing the date that the account was opened, and the credit reporting bureau can’t verify it, and they pull the whole listing off your report!

You can’t keep submitting the same dispute reason over and over again to the bureau – they will view you as a nuisance and will dismiss your disputes as frivolous.

Also, don’t bombard these folks with your disputes – you won’t get the desired results. But, you can dispute information that needs to be verified. The suggested order of ways to dispute are:
  1. Not my account
  2. I didn’t pay late that month
  3. That is the wrong amount
  4. That is the wrong account number
  5. That is the wrong original creditor
  6. That is the wrong charge-off date
  7. That is the wrong date for the last activity on the account
  8. That is the wrong balance
  9. That is the wrong credit limit
  10. That is the wrong status of the account
  11. That is the wrong highest amount I owed at any time (High Credit Amount)
You can challenge the same listing on your credit report in the Rinse and Repeat phase. The first time, you might say “not my account” and the next time you would say “I was never late.”

You just never know when you’ll find the dispute that gets the listing taken off of your credit report. Send your dispute in, and let the 30 day clock run.

But, like I said before – don’t bombard them immediately after getting your results. Wait 60 days between disputes. Keep excellent records of your efforts. Be persistent, be insistent, and more than likely it will pay off. Thinking about a short sale?

Step 6 To Fix Your Credit After A Ventura County Short Sale: Why It’s So Important To Document Everything

The credit reporting companies have 30 days (by law), to investigate and handle the disputes submitted to them. This is why you submitted everything through certified mail.
That enables you to record the time firmly for the credit reporting firms to respond within. But it’s more than that. This file will become important for a long time for you.
Many people successfully removed items from their credit reports. Later on they found those same items show back up on their credit report months in the future! Having a record of your efforts and the results is needed to keep your record blemish free in the future.
Make your records easy to follow. You will need to keep the original copy of your credit reports here, as well as the copies you’ve made notes and comments on.
Keep copies of the letters you send to the credit reporting companies. Keep the Certified Mail slips. File any correspondence that the credit reporting companies send to you.
Keep a journal in your file of any telephone conversations you have with any of the creditors or credit reporting companies. Record in this journal the names, dates, times, and notes of these phone calls.
In addition, have a method to remind yourself of “action step dates” – those dates where you expect to have a certain action done by the credit reporting firms.
This can be a calendar you keep on the front of the file, or use Outlook’s calendar feature, or your calendar app on your phone.
This may seem like your credit report has become your new part time job, but with a little bit of organization and perseverance, it will be worth it! Thinking about a short sale?

Ventura County Loan Mod Help: Sick Of Your Loan Mod Taking Forever? Try Contacting Congress

. Chris has been Certified as a California Association of Realtors HAFA Specialist, a National Association of Realtors Short Sale and Foreclosure Resource
Certified Short Sale Specialist. Loan Modification Denied? HARP re-fi denied? Want to avoid foreclosure?

Ventura County CA – We recently sent everyone in congress a fax about a certain large bank. They had done a lousy job on a short sale file. We waited 90 days for an answer on an offer.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

The buyer was impatient and canceled their contract. Fortunately we had a backup buyer. Instead of using the BPO that Freddie Mac paid for and reviewing the new offer, the negotiator closed the file. Freddie Mac, the owner of the loan, stands to lose $75 spent on the BPO and 90 days worth of interest.

We estimate that Freddie's loss over the delay to be around $1,249. Rather than just sit here and take abuse, we decided to stand up for ourselves.

We found the entire list of fax numbers for congress, typed up a fax, and sent it out. If your loan mod is taking too long, then fax everyone in congress. Most many loans are federally insured or guaranteed, such as Fannie Mae owned loans, Freddie Mac owned loans, FHA insured loans, VA insured Loans, and even USDA insured loans.

This leaves these banks open to huge liability. If they mess up on a federally owned or insured mortgage, then they are causing Uncle Sam to lose money.

Sometimes You Need To Look At A Ventura County Short Sale From The Lender’s Perspective

THE BEST REAL ESTATE AGENT SERVING VENTURA COUNTY CA, The Best Short Sale Agent in Ventura County, CA, The Best Short Sale Realtor in Ventura County, CA, The Best Certified Short Sale Specialist in Ventura County , CAThe Stop Foreclosure Institute of Ventura County got a few coments from yesterday’s blog post. Most of the questions went something like this. "I think a lender would be stupid to approve an investment property short sale for a wealthy person. If I was the lender I would sue them for the loss. Jan.” The bottom line is that people didn’t think a lender would allow a wealthy person to walk away from the debt on an investment property.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure. Here are a few reasons that a lender will allow a wealthy investor to walk away from an upside down investment property.

Lenders know that if they can give a customer what they want, then it will help them. If they don’t give a customer what they want, then everything turns into a fight. Some homeowners will hire a lawyer to review every clause in the mortgage.

They will check to make sure that each clause of the mortgage meets every single conceivable state and federal law. Other people will declare bankruptcy to avoid paying the debt. This is the biggest impediment keeping lenders from collecting on a debt. Debt is very hard to collect even in court. In fact, only around 8-10% of all judgments are ever collected.

That means a lot of people and lenders spend thousands of dollars in court getting a judgment, only to never collect the money. This is one of the reasons that a debt collection company recently bought $20 Million Dollars worth of Deficiency Judgments for $150,000.

I don’t know which lender sold them, but apparently that is all they thought they were worth. I hope this helps you see why a lender would find it simpler to approve a short sale rather than pursuing a debtor in the hopes of collecting on the deficiency.

Thinking about a short sale? I can help you short sale your property and get back on your feet. Send me an e-mail at cjohnson@prucalhomes.com. I will contact you for a free consultation.

Ventura County Short Sale News: Loan Servicer Doesn’t Follow VA Short Sale Guidelines On A Short Sale Of A VA Loan

http://www.ChrisBJohnsonRealtor.comVentura County Short Sale Negotiator – We recently negotiated a short sale on a VA Loan. After the appraisal is complete and all the other necessary document have been received, VA guidelines state the loan servicer should give us an answer within 15 days.

The loan servicer took 65 days to give us an answer. That is a complete violation of VA’s requirements. “Oh, but that’s no big deal”, you might say.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.
It is a big deal, because VA (and every single US Taxpayer) loses money as a result. VA insures VA lenders against loss, provided they follow their guidelines.

VA is able to make an “educated bet” that they can issue these guarantees because they have laid out rules to control the lending and loan servicing environment. When the company servicing the loan doesn’t follow VA’s guidelines, it is no longer an “educated bet.”

Most short sales that get turned down and foreclosed upon sell for less as a foreclosure. That means VA loses even more money.

I can tell you from experience as a Gainesville Short Sale Realtor that the 60 day turn around means that VA loses a lot more short sales to foreclosure.

But no one really cares because it almost a victimless crime. At least the victims don't care. The employees at VA don't get hurt because it's not their money.

The US Taxpayer already knows the government wastes money. The victim ends up being American's Veterans who don't have as much money in the VA Loan Program to use to buy a house. Thinking about a short sale?

Ventura County Short Sales: Isn't It Time For A REAL Homeowner's Bill of Rights?

The Best Short Sale Agent in Moorpark, CA, The Best Moorpark Short Sale HELP, The Best Certified Short Sale Specialist in Moorpark, CAVentura County Short Sale Help – The big banks made mistakes and received a bailout. They have the resources to lobby congress and the courts to have laws written to suit them.

But, what has the little guy received? Nothing. So we decided to put together a Homeowner's Bill of Rights. It's time we had Washington look at what we want, versus taking care of the big banks.

Click here to discover how other sellers successfully did a short sale and avoided foreclosure.

Considering that the big banks have way more rights than the little guy, here is what we think should be done to "level the playing field."

The Homeowner's Bill of Rights.

1. Stop The Loan Modification Insanity! The Right to an open and transparent loan modification process.

Any homeowner that can no longer afford their mortgage payment, petitions their lender for a loan modification, and it turned down shall receive a written, coherent response from their lender detailing why they were denied and what they can do to be approved for a loan modification.

2. The right to get an answer to a voicemail or e-mail from a loan mod or short sale negotiator within one business day.

3. The right to obtain the rules and guidelines for the loan modification of short sale from the loan servicer.

Most loans are owned or insured by someone other than the lender the homeowner mails their payment to. However, these front entities still make decisions contrary to the investor or insurer's guidelines.

As such, the loan servicer should send any and all guidelines regulating the loan modification and short sale process to the homeowner.

4. The right to deal with one person who will make the decision to approve or deny their loan modification or short sale. This person should be available to reach by phone or e-mail.

5. The right to attempt to negotiate a loan modification or short sale without fear.

The homeowners have the right to have all foreclosure proceedings stopped when they are negotiating a loan modification or short sale.

Many lenders use an impending foreclosure sale date to force a higher payment from a homeowners attempting to secure a more affordable payment.

Many times the reason the sale date is so near is because the lender has dragged their feet on negotiating with the homeowner.

Because they are under duress, many homeowners will agree to a payment they cannot afford. Sure the loan mod negotiator at the bank gets a bonus.

But, everyone loses when the homeowner re-defaults and the lender has to process a loan modification all over again.

6. The right to walk away from their upside down mortgage debt.

We often see the lenders hold such a hard line on getting repaid everything they owe that they allow the collateral (the home that is mortgaged) decline in value even more than they ever would have received as repayment from the debtor.

7. Stop the Debt Collector Harassment! The right to tell any and all debt collectors to stop calling and never receive a phone call from then again.

In addition, this would include debt collectors that know the person's phone number, but will call family members in an attempt to embarrass the debtor.

This is America people! Debtor's prison was abolished two centuries ago! It's time to update your activities to the Twenty-First Century!

8. The right to have their short sale handled competently. The short sale process with most lenders is seriously flawed.

Because of this, we see short sale offers for 385k rejected, only to see the home sell for 230k after foreclosure. This hurts homeowners, the banks, the housing market, and the American Economy.
Is it fair to pursue a homeowner for a larger deficiency when it was the lender's decision to reject the short sale that caused the deficiency to be larger? I don't think so.
Because of that, the homeowner has the right to have their short sale handled as detailed below.

A. All deficiencies are forgiven. We often see the lenders hold such a hard line on getting repaid everything they owe that they allow the collateral (the home that is mortgaged) decline in value even more than they ever would have received as repayment from the debtor.

Making the infamous difficult short sale process simpler and more attractive to buyers would net the banks way more money than will ever be recouped chasing down sellers.

B. To have their short sale handled to process everything as smoothly and quickly as possible so the home sells for top dollar and the loan owner receives the most money possible.

C. The right to work with a competent, experienced agent who specializes in short sales.

D. The homeowner is given a written list of investors, mortgage insurance companies, etc. (with contact information) that need to be satisfied for the Short Sale to be approved.

E. An appraisal is ordered and then the home is listed for sale at that price. The price is dropped by 5% a month, or whatever that lender's standard price drop is for Bank Owned Properties.

F. Home buyers get an answer to their offer within 2 business days.

G. An appraisal is ordered and then the home is listed for sale at that price.

H. Allow short sale buyers 45-60 days to get their loan approved. Many lenders that have loan servicing departments that handle short sales.

These departments demand that a home buyer close the transaction within 30 days of short sale approval. However, these same companies have lending sides that cannot close a loan in less than 45-60 days.

So essentially, they are demanding that other banks close loans in 30 days, when they themselves cannot do the same thing. I would call that serious hypocrisy! Don't you agree? Thinking about a short sale?
